EFF leader Julius Malema found guilty of breaching parliament’s code of ethical conduct on two counts.

The joint committee on ethics has found that Malema violated the code of ethics for MPs by failing to uphold the law when he called for foreign nationals to find “creative ways” to enter SA after its borders were closed in terms of the Covid lockdown in January.

The committee has left it to the National Assembly to determine a sanction against Malema. According to the code, Malema could be reprimanded by the house and/or have some of his salary docked.

The ethics committee probed Malema on the matter following a complaint filed by ActionSA leader Herman Mashaba.

The committee also found that Malema had breached the ethics code in his questioning of judge Keoagile Elias Matojane during Judicial Service Commission (JSC) interviews in April.

Malema should not have questioned the judge on a matter that personally involved him and his party — a defamation lawsuit against it brought by former finance minister Trevor Manuel.

After watching video footage of Malema’s questions to Matojane, the committee was of the view that as a representative of the National Assembly on the JSC he should not have asked questions about a case that related to him personally.

“You are required to serve the interests of the public and not use the platform for your own interests, especially since the matter, at the time of the interview, was before a court of law,” ethics committee registrar Anthea Gordon wrote to Malema this week.

“In light of this, the committee found that you breached the code.”

Malema was found to have breached a section of the code that stipulates that MPs must act on all occasions in accordance with the public trust placed in them; and discharge their obligations, in terms of the constitution, to parliament and the public by placing the public interest above their own.

Malema has until October 7 to submit written representation on a penalty or sanction.

The Council for the Advancement of the South African Constitution (Casac) laid a three-part complaint about Malema’s conduct during the interviews.

On the other two complaints, the committee found that Malema’s criticism of the Zondo commission of inquiry into state capture was allowed within the realm of politics as many politicians express different sentiments on the Zondo commission.

It also found nothing wrong with his questioning in which he suggested judge Dhaya Pillay was a political activist aligned to a Pravin Gordhan faction.

Casac had taken issue with Malema saying the state capture commission, chaired by acting chief justice Raymond Zondo, had a factional agenda and was protecting the white capitalist establishment.

With regard to Malema’s questions to Pillay, the committee “considered your line of questioning to be within the interest of the public”, Gordon informed Malema.

“Also … you did not accuse judge Pillay of being a political activist as you used the words, ‘I put it to you that I will argue in the closed session that you are a political activist …’ to which judge Pillay replied, ‘No, I am not.’ The committee considered this to be fair,” Gordon said.

Malema was found to have breached the code for his call made in January to foreign nationals to find “a creative way” to enter SA if they were not allowed to get into the country through the border posts.

“So let the borders be opened and if the gates are not going to be opened for Sadc [the Southern African Development Community], fellow Sadc people please find a creative way. This is your home, your families are here,” he told journalists.

“There is no ways anyone is going to close you out here. Lesotho and Free State are one thing, Mpumalanga and Swaziland are one thing, North West and Botswana are one thing, Limpopo and Zimbabwe are one

thing. What is the point? There is no point at all,” he said at the time.

The committee found that Malema’s words were contrary to lockdown regulations announced in January, which closed land borders with limited exceptions for entry. It found that he breached the code of ethical conduct and disclosure of members’ interests, in failing to uphold the law.

Mashaba wrote to the then National Assembly speaker Thandi Modise accusing Malema of inciting foreign nationals to violate the country’s laws through his utterances. Mashaba called on parliament to take action against Malema.

During a campaign to have people register in the upcoming local elections, EFF leader Julius Malema speaking in Diepsloot, Johannesburg asked people if they are “well in the head” for continuing to vote for the ANC.

In his address during a community meeting in Diepsloot Park on Saturday, Malema tackled many issues such as formalizing Eskom to fix electricity problems faced in the township, land, registering to vote and how voting for the ANC won’t bring change.

“Now, you stay in a shack. You applied for a house since 1994. But you continue to vote for the ANC. Are you well in the head?” he said.

Malema urged people to register to vote, to get the ruling party out of power. “Let us go check our names, and those that are not registered must register.” He adds that this will teach the ANC a lesson if dissatisfied voters register in their numbers.

“Change is your vote, you have been voting the same thing and things are remaining the same. Maybe if you change your vote, things will change,” he told the Diepsloot community.

Malema said that people lack the patience and consistency of the late struggle icon, Nelson Mandela. Mandela was incarcerated in Robben Island for 27 years, the EFF leader says communities lack the fighting spirit of Mandela and then stop voting.

He further went on to say, the ANC’s problems never started with former president Jacob Zuma, however, he did make things “worse.”

“The ANC is responsible for this mess, we voted for the ANC, not for Zuma. It is the ANC that sold the people of South Africa and we must teach the ANC a lesson…The whole thing is rotten.”

On the land issue, Malema says the party ones to give land to the people who need it, “and those who are able to build for themselves can build for themselves…

“We don’t want you to buy the land, we want you to be given the land… When we marched in the 80s, we said we don’t want matchbox houses. But the ANC government gave us worse than the apartheid people. We want to give you proper houses.”

He added that when you give a “poor person a house, you are restoring the dignity of that person.”

The EFF on Saturday maintained that it did not receive any donations above R100,000, between April and June this year, that needed to be declared to the Independent Electoral Commission (IEC).

The Red Berets were among 502 political parties that did not disclose any donations, while the ANC, DA and ActionSA declared donations totalling more than R30 million.

Economic Freedom Fighters (EFF) Julius Malema has defended newly appointed City of Johannesburg mayor Jolidee Matongo amid xenophobic comments about him.

Matongo was elected the new mayor of the City of Johannesburg during a special meeting held by the council for the mayoral election this week.

This follows the death of mayor Geoff Makhubo in July, who succumbed to Covid-related complications.

Matongo, 46, hails from Soweto, and is a member of the ANC Johannesburg regional executive committee.

He has a diploma in public management and development, a B-Tech degree in public management, and a post-graduate diploma in management.

Matongo is also currently pursuing a master’s degree in public management.

Before becoming executive mayor of Johannesburg, Matongo was a student activist, sinking his teeth into politics at just 13. He also served in the ANC’s communication department for a number of years.

Despite his political credentials, social media users have called for his removal on the basis that his father is a Zimbabwean.

The hashtag #WeRejectMayorOfJHB has been trending on social media following his election, as some call for his removal.

There are, however, those who have jumped to his defence, calling out the hypocrisy displayed by those who reject Matongo but celebrate Trevor Noah, who was born to a South African mother and a father of Swiss-German descent.

EFF leader, who has always called out South Africans for their xenophobia, also jumped to Matongo’s defence, telling people not to involve him in their “nonsense”.

“We grew up with Jodilee Matango in the YL, and today, we are canvassed to reject him because his father was Zimbabwean. I’m sorry, don’t count me in your nonsense. Politically we disagree, but he remains a black brother of mine. #NoToXenophobia,” said the EFF leader on social media on Thursday.

One SA Movement leader Mmusi Maimane has also called on South Africans to desist from spreading xenophobic messages about Matongo.

“Oksalayo Jodilee Matango is South African, Soweto born and we must not entertain xenophobia. You can engage people on their ideas, on their track record of delivery as leaders, on their political choices. But xenophobia, that’s not acceptable. Not today or any other day,” said Maimane.

Twitter has suspended Julius Malema from posting on his account, after he was reported for his remarks on the SANDF deployment in KZN and Gauteng.

Julius Malema has had a number of features on his Twitter account suspended, for a 12 hour period. This follows posts he made about the ongoing unrest in parts of South Africa, where he likened the SANDF deployment to a ‘war on civilians.’ Of course, the 40-year-old is no stranger to stirring trouble online – but he may have gone too far this time.

The party’s deputy president Floyd Shivhambu on Tuesday evening.

Shivambu shared a screengrab of Malema’s profile displaying a message of suspension.

He threatened that if the SANDF is deployed, the party would encourage its supporters to join the protests as it was a declaration of war.

“No soldiers on our streets! Otherwise, we are joining. All fighters must be ready… they won’t kill us all. We need a political solution to a political problem, not soldiers,” reads Malema’s tweet.

Malema said that deploying the army and calling for a state of emergency was going to have innocent people killed.

The Democratic Alliance (DA) said that it would lay criminal charges against Malema and former president Jacob Zuma’s children, Duduzane Zuma and Duduzile Zuma-Sambudla following their remarks on social media.

“It’s time for Duduzile Zuma-Sambudla and many others who have incited violence to be held accountable for the looting and violence we have witnessed over the last few days,” said DA leader John Steenhuisen on Wednesday.

“It is completely wrong for leaders to be doing this in South Africa in a situation like this. It’s no secret that leaders of the pro-Zuma faction, as well as others with aligned interests, have been fanning the flames on social media with impunity,” explained Steenhuisen.

The pupil seen in a video supposedly being manhandled by security guards at a Centurion school “for wearing Economic Freedom Fighters’ (EFF) regalia” has a history of defiance and was under suspension on the day, the Gauteng department of education said.

Reacting to reports shared on social media that a Hoërskool Uitsig pupil was barred from entering the school because he was clad in the party’s regalia, the department said this was not the case.

The incident occurred last Friday, departmental spokesperson Steve Mabona said.

On the day, the school launched its academic week and pupils were required to wear clothing depicting their desired careers.

The video shared on social media and retweeted by EFF leader Julius Malema showed a pupil being grabbed by a white security guard. The pupil, clad in a red beret, black T-shirt and red jacket, shouts “look what they are doing”.

Another pupil is also heard shouting “racists” while the white security guard tries to stop him.

Mabona said: “The pupil in question has a history of defiance and disregard for the school’s discipline system and the code of conduct. He currently has more than 800 demerit points and awaits a formal school governing body disciplinary hearing.”

“The event took place during a period where said pupil was suspended for seven days. However, irrespective of his temporary suspension, the pupil unlawfully entered the school premises, in effect breaching conditions of his suspension.

“This prompted the security personnel to remove the [pupil] from the school yard – in line with the school’s code of conduct.”

District officials were working closely with law enforcement agencies to monitor the situation at the school, especially as threats of protest action were received, Mabona said.

The Federation of Governing Bodies of SA Schools said it had mandated the school’s governing body to thoroughly investigate the incident before taking any action.

SA Human Rights Commission Gauteng manager Buang Jones said the commission would investigate.
