Media personality Penny Lebyane said she felt unappreciated by people in the entertainment industry.

She claimed she helped a number of people in the industry yet they won’t acknowledge the impact she had in their lives.

She said instead they were waiting for her to die before they thank her.

Taking to Twitter on Saturday, she wrote: “They won’t acknowledge me for what l’ve done for the industry but do everything and repeat everything I’ve said like it’s the freshest thing ever.

“They’re waiting for me to die so they can talk about my impact on them. Guess what? I am not and l know what l did for u and u.”

Her industry colleague, poet Lebo Mashile, agreed with her. She said generally artists are only appreciated once they’re dead.

“This is how this country does creatives. I have often felt the exact same way. It’s not you – it’s this toxic space,” she wrote.

A twitter user, Thami Mhlanga, advised Penny not to wait for others to acknowledge her contributions. Instead, she must tell her own history for future reference.

“Sis Penny, please align us with your history in the industry so we can get first-hand information from the human herself. Please,” said Thami.

“When you guys die, knowledge goes with you because, as you all know, we’re still reluctant to record our journeys. We are still anti-diaries.”

Another Twitter user, Goodwill Mbambo, acknowledged Penny: “There are some of us that know and appreciate what you’ve done for the industry. Some of us have been following you since you started on radio in the 90s.”

Khumbudzo Munyai also consoled Penny and wrote: “You don’t really need their acknowledgment, Penny. We know what you’ve done for the industry and don’t stop. Keep doing what you are doing.”

Radio veteran DJ Fresh will not be returning to radio any time soon.

DJ Fresh (Thato Sikwane) and fellow DJ Euphonik (Themba Nkosi) were let go by Primedia pending the outcome of an investigation into rape allegations levelled against the pair earlier this year.

They initially announced they would be stepping back from all public engagements pending the outcome of the investigation, before changing their minds and resuming public life as normal.

DJ Fresh has been playing at live events and keeping his social media up to date but recently let his large fan base know he would not be returning to radio.

“RADIO KING!!! Ps. You can rehire, but you can NEVER “replace” me!! #DontGetItTwisted,” wrote Fresh, seemingly taking a jab at his Drive Time replacement at 947, Thando Thabethe.

“Pps. Part of your legacy is radio features so solid/strong, that it becomes programming suicide to get rid of them,” in reference to Thabethe continuing to make use of the features Fresh and his team conceptualised during his time at the station.

Fresh said he was unable to return to radio for a competing station because of what he calls “a stupid restraint of trade” he says he agreed to during the “honeymoon phase”.

Embattled radio personality Themba “Euphonik” Nkosi’s tweet has landed him in hot water following a string of social media posts linked to a sexual assault case against him and co-accused Thato ‘DJ Fresh’ Sikwane.

The musician might have to pay up after the alleged victim in the case, which was withdrawn in February, took him to court for his social media posts about her.

In January, Euphonik and DJ Fresh were named in a tweet by the Pretoria-based woman, who called herself “Nampree” on the public platform, as perpetrators in an alleged sexual assault that occurred 10 years ago.

The harmful statements were transmitted to and possibly read by 2 million of the first respondent’s current Twitter following.

In documents filed at the Johannesburg High Court, Euphonik is named as the first applicant and DJ Fresh as the second, with the alleged victim seeking R500 000 for defamation of her character.

“I seek protection from this honourable court for the ongoing harm I am suffering because of the harmful statements (defined below) in the form of interdictory relief against the first respondent in order to interdict and refrain the first respondent,” read the first part of the funding affidavit from the alleged victim.

“[They are] infringing my rights to dignity, freedom and security, as well as privacy.”

“[They are] making damaging comments to the media or through the media, concerning my name, my private life, my family, my reputation and/or the private and confidential details of the criminal case,” the founding affidavit read.

Euphonik did not answer his phone or respond to an SMS sent to him requesting comment.

The lawsuit has singled out Euphonik following social media posts he made, which allegedly referred to Nampree as a “liar”, an “extortionist” and as being “dishonest” regarding the rape allegations.

The star responded to a post by Nampree with these words: “LOL because being a liar, an extortionist, a scammer and falsely accusing people you’ve never met isn’t profitable, hey … get help.”

At the request of Nampree’s legal team, the post has been deleted.

In the court document, Nampree requests an apology from the radio head. Euphonik is also under fire for sharing Nampree’s contact details on his Twitter page, which has more than 1.8 million followers.

In a separate Twitter post in February, the property mogul shared a screenshot of a WhatsApp message purporting to be from Nampree apologising to the duo for the rape case.

They are saying she accused them of rape, so she is lying and has defamed them because the police never investigated.

However, Nampree stated in the court documents that the apology was not sent by her.

“Furthermore, on February 27 2021, the first respondent tweeted a fake and constructed WhatsApp message exposing my personal cellphone number.

“The harmful statements were transmitted to and possibly read by 2 million of the first respondent’s current Twitter following. The harmful statement published and widely shared contained certain derogatory and defamatory statements regarding me. It is clear that the first respondent had the intention and proceeded to publicly disseminate the fake WhatsApp message by adding malicious context and his wholly unsubstantiated opinion.”

The ‘fake’ apology sparked outrage from gender-based violence activists and celebrities, leading to a march to the offices of Sunday World to retract an article based on the message that was allegedly fabricated by the star.

Celebgossip has also learnt that Euphonik and DJ Fresh are countersuing their alleged victim for defamation of character. The duo have filed court documents demanding R1 million from her.

“They are suing her for crimen injuria and defamation of character, and are demanding R1 million. They have filed, so we will wait for the process,” said Nampree’s legal representative, Brenda Madumase

“They are saying she accused them of rape, so she is lying and has defamed them because the police never investigated. Even the National Prosecuting Authority [NPA] decided not to prosecute, so, on that basis, they believed she was being dishonest.”

DJ Fresh declined to comment on the lawsuit.

Both matters will be heard in court at a date that has not yet been confirmed.

The case of rape that was opened at the Sunnyside Police Station in January against the duo – who hosted different radio shows on Radio 947 at the time – was withdrawn in February.

In a police affidavit t, Nampree accused the duo of drugging her and then raping her.

She said the incident took place in June or July of 2011, when she was a second-year student at the University of Pretoria.

She alleged that she had been invited to an after-party hosted by Euphonik at a bed-and-breakfast venue, where she met him and DJ Fresh.

The matter was withdrawn by the NPA on the grounds of insufficient evidence.

DJ Fresh and Euphonik’s rape accuser, who claimed to have lost her virginity when she was raped by the two, allegedly had alcohol-fuelled sex in a car with a Diepsloot man before her alleged rape incident.

These startling details are contained in a police statement, which the National Prosecuting Authority (NPA) is understood to have taken into account when it decided not to prosecute the two entertainment moguls for rape.

The 41-year-old man, who cannot be named for legal reasons, said he had sex with the woman in a car in March 2011 after meeting her at House 22 in Pretoria.

“On that specific day in March 2011, I can’t remember the day. We were drinking at the pub, later we went to my vehicle… we have sex with her consent [sic]. It only happened once. After the sex, we went back to the pub. She was not a virgin because she knew what to do, she was experienced,” the affidavit reads.

The woman trended on social media platforms yesterday when she sent Euphonik, real name Themba Mbongeni Nkosi, a Whatsapp message apologising for falsely accusing them of rape.

“Themba, I’m sorry for what I did to you and DJ Fresh. The people who made me do this are turning away from me bc the lawyers want to push this further and the truth will come out but it was all a lie and I don’t know what to do bc nyani I’m scared I’m going to be arrested. Journalist are calling me everyday [sic]. Please forgive me,” reads the message.

Sunday World tried in vain to solicit comments from the woman, but her cellphone rang unanswered and she did not respond to a message sent to her.

However Euphonik confirmed that the woman had sent him a message.

“She sent it to me this morning. I would not want to discuss this with the media, but this is bad for the guys because if this kind of storm hits some guy who doesn’t know how to fight it, what would happen? He would hang himself.

“You can see the comments from people even after the state had decided not to prosecute, many of them said it doesn’t matter whether it happened or not, she has done the right thing. It hurts,” said Euphonik.

Asked if he would extend an olive branch to her, Euphonik said. “Even if you sue, her what are you going to get from her?” he asked.

Asked if he was going to press any criminal charges against her, Euphonik, who was dismissed from 94.7 radio station as a result of these accusations, said he was waiting for advice from his lawyers.

“But bear in mind that it is the state that could open a perjury case against her, not me,” he said.

NPA North Gauteng regional spokesperson Lumka Mahanjana said the authority decided not to prosecute due to “a lack of sufficient evidence”.

However, the DJ is still doing the most to prove his innocence in the court of public opinion.
Taking to social media, DJ Fresh posted a statement from his accuser’s star witness.
The witness denied being present at the time of the alleged rape and refuted the claims made by the alleged victim, Ms Madikizela.
He posted: “Nampree’s friend and “star witness” also confirms under oath that this is a lie.”

After their announcement that they would be “stepping back” from their public engagements for the foreseeable future, DJs Fresh and Euphonik seem to have changed their minds.

Fresh and Euphonik’s about-turn was announced in a statement shared to social media earlier this week.

“After extensive consultation, legal and otherwise, we have concluded that it is in our best interest to resume all of our public engagements,” read part of the statement.

“We look forward to our names being cleared,” added the pair.

This decision also comes in light of the announcement by Primedia that they would essentially be firing the pair from radio station 947.

A decision that both sides chalked up to not being able to find “common ground.”

In mid-January, the DJs stated that they would be “stepping away from all public work and engagements” until their ongoing legal woes had been resolved.

The legal woes in question came after a woman tweeted an accusation against both DJs alleging that they had drugged and s.e.xually assaulted her back in 2011.

Three weeks after being pulled off air as they faced rape allegations, Primedia Broadcasting confirmed on Wednesday that DJ duo Thato “DJ Fresh” Sikwane and Themba “DJ Euphonik” Nkosi have been “released from their contract”.

“Primedia Broadcasting can confirm that, after careful consideration of the events of the last few weeks, the company has decided to release DJ Fresh and Euphonik from their contracts. Their last shows on 947 were aired on January 15 and January 10, 2021, respectively.

“This decision does not reflect a view on the veracity of any allegations against either Euphonik or Fresh. Rather it prioritises Primedia Broadcasting’s business imperatives. We believe that this decision is in the best interest of our company and our various stakeholders,” said Geraint Crwys-Williams, interim Primedia Broadcasting CEO.

Meanwhile, DJ Fresh has issued a statement on Twitter confirming that they would be resuming all public engagements.

“After extensive consultation, legal and otherwise, we have concluded that this is in our best interests to resume all of our public engagements. We look forward to our names being cleared. Unfortunately, we can’t find common ground with Primedia and have agreed a release from our obligations to the broadcaster, with immediate effect,” read the statement.

Rape allegations against the duo came to light earlier this month after a woman took to Twitter to detail the alleged incident, sparking a widespread debate among South Africans on social media.

In an exclusive interview with local newspaper, the woman, who requested her name not be published, confirmed she had opened a case of rape at Sunnyside police station on January 13.

She said the alleged rape occurred in 2011 at a chillas (small party) she attended with a friend, who was apparently invited by one of the DJs. At the time, she was a second-year student at the University of Pretoria, where she was studying towards a bachelor’s degree in commerce.

“First, I want to make it clear I was not some kind of stocko or whatsoever people call girls organised to entertain the DJs. I was simply accompanying a friend to a chillas, and that’s where the whole thing happened,” the woman told TshisaLIVE.

Police spokesperson Capt Mavela Masondo confirmed the existence of the case to TshisaLIVE on Thursday.

In light of the allegations Fresh and Euphonik had decided to step away from public engagements and “allow the law to take its course”.

This is not the first case of sexual harassment he is caught up in. The DJ has been taken off air in light of rape charges that he is facing alongside his best friend, DJ Euphonik. What began as a tweet of a girl who says she was drugged by the music duo resulted in charges being officially laid against Euphonik and Fresh. The duo having denied the rape allegations, has also launched charges of their own, possibly defamation of character.

She was visiting a friend who worked at the said place and who was friends with DJ Fresh. The said friend then invited her along with a few other women to Fresh’s after party.

After a number of Hunter’s Dry ciders, the accuser then blacked out but when she woke up she remembers that her body was in pain and that she felt as though someone had penetrated her. However in her statement she says that there was no blood. Before she could wake the other females, the DJs laughed at how drunk they were and that they had to carry them to bed.

Ever since this was leaked to the media, @Nampree, which by the way is not her real name, accused the police of foul play when she said, “Police leaked my statement. Lol ya nhe @SAPoliceService.” This raises concerns for many because incidences such as these are not new, worst case scenario could be that no further investigation will take place. Dockets too going missing is also an occurrence that is not foreign. Her supporters including the outspoken Ntsiki Mazwai offered to help her get to the bottom of things

The legal showdown between media heavyweights and former lovers Penny Lebyane and DJ Fresh is set to take place in the Johannesburg High Court on Wednesday.

This forms part of a court application by Lebyane to join in as a second respondent in an interdict hearing brought forward by DJ Fresh, whose real name is Thato Sikwane, against poet Ntsiki Mazwai last year.

Fresh filed a suit against Mazwai following the poet’s social media posts that the DJ was an alleged rapist.

Mazwai’s posts followed allegations made by Lebyane that she had been abused by a former lover, who Mazwai concluded had been DJ Fresh.

This after DJ Fresh, who was romantically linked to the broadcast veteran 20 years ago, mentioned her in his founding affidavit.

Lebyane said that she was entering the court matter to clear her name and demand clarity regarding how her name became a prominent part of a court case that she was not a part of.

“In that matter, I am mentioned in the court documents. What happened is that we tried to get him [DJ Fresh] to explain himself and produce evidence of the things that he accuses me of … Eventually, we asked to do a joiner in the case,”she said.

DJ Fresh declined to comment on Lebyane’s entering the court case, only saying “everything will unfold in court”.

“There is a gag order in place in respect of the main application, which precludes the contents thereof from being disclosed. My attorneys have responded to Ms Lebanye’s application to join the proceedings, which application will be dealt with simultaneously with the main application on Wednesday.

“We remain of the view that there is no basis for the joinder application and have set this out in the papers. The issues will all be ventilated at court,” said DJ Fresh.

In the affidavit deposed by DJ Fresh, the 94.7 presenter said Lebyane was the original poster of a tweet that insinuated that he was involved in alleged sexual misconduct. Mazwai reposted the tweet that landed her and DJ Fresh in court.

“Insofar as Penny Lebyane, the author of the original post concerned, I dated her briefly in 2001, [that is] 19 years ago. I broke up with her because our relationship was toxic and a restraining order was obtained against her after she attempted to force friends of mine off the road. I have not had dealings with her since,” the affidavit reads.

Lebyane claims she was never served with a restraining order by the star, and says she seeks clarity on the existence of the document and what it entails.

“In his founding affidavit, he cites that I originated the post that Ntsiki retweeted, which is not true. The second thing he says [is about] a restraining order against me from whatever years ago, which to my knowledge is not true,” she said.

“We are questioning how you mention me in a court document without giving me a right to answer for myself. I also want to understand how whatever decision the judge makes against Ntsiki affects me,” she added.

Lebyane says her being mentioned in the court documents has tainted her image and cost her potential job offers.

“I just want to understand what his intentions are with my being mentioned in this document. Can he furnish me with proof of the things that he is saying about me? One of the things is that I do a lot of advocacy work around mental health … He says I am toxic and I find that statement very problematic.

“I am not just some girl. Even if I wasn’t a citizen of this country, if you mention me in a legal document, I have a right to understand why my name is mentioned in that legal document.

Secondly, Penny Lebyane is my legal trading name; it’s a name that I use for work, so the implications are financial for me. So I need a clear understanding of what that means. I have been excluded from work projects because of my name being associated with that document and I do not have an explanation for it,” she fumed.

The media personality says she is seeking access to DJ Fresh’s court documents and will deal with the consequences of her name being dragged into the papers later.

Meanwhile, DJ Fresh is facing a mountain of legal battles as he has a pending case that was brought forward by a Pretoria-based woman who accused him and Themba ‘Euphonik’ Nkosi of sexually assaulting her 10 years ago.

The pair stepped down from their duties on 94.7 after the case was opened three weeks ago.
