DJ Fresh gives Black Coffee his flowers on his radio show, Flowers Friday.

The radio star expresses love to the Grammy nominee, and also applauded him for garnered achievements over the past years.

Taking to Instagram, Fresh shared a snippet of the show and penned down an emotional note.

“What a wild ride it’s been. I have been one of your biggest fans for close to 15 years now, and you have been nothing but a global inspiration. It’s no coincidence that Inkodlo Kamashimane, (which you created in your late father’s honour seven years ago), was featured in The Matrix Resurrections film at the end of last year. THAT milestone is actually the ramp that’s gonna catapult you to heights your career has never experienced, in 2022,” he wrote.

“I love you bro, and thank you for proving to everyone, that “the writing of your ‘arrival’ is never ever on the wall” until you are done building and now even own the damn wall,” DJ Fresh added.

A defamation tussle is unfolding in the Johannesburg High Court between former radio jock Thato Sikwane, popularly known as DJ Fresh, and the woman who accused him of rape earlier this year.

The former 94.7 and Metro FM host approached the court in April, seeking an order to compel the young woman to pay R500 000 for claiming that he and Themba Nkosi, known as DJ Euphonik, raped her.

The woman filed her intention to defend the lawsuit in the same court in October.

When approached for comment this week, she said: “I am not in a position to respond to any of your questions.”

Sikwane’s court application came after the National Prosecuting Authority (NPA) decided to withdraw the rape charges against the two DJs in February.

Spokesperson Lumka Mahanjana confirmed that the NPA had decided not to prosecute the two men.

“The docket was indeed presented to the prosecutor. Upon perusal of all available the evidence in the docket, a decision not to prosecute was taken,” Mahanjana said. He added:

There are no prospects of a successful prosecution on the available evidence, because it is insufficient.

The NPA subsequently withdrew the case of crimen injuria laid by the DJs against the woman. In his court papers, Sikwane said he had suffered immense harm to his reputation and to his ability to earn a living.

“On or about January 11 2021, and at about 4.03pm, the defendant authored and published a defamatory publication concerning the plaintiff [Sikwane] via the social media platform known as Twitter, wherein in the following was stated:

“@DJ FreshSA and Euphonik will you ever acknowledge drumming [sic] & further raping me? I was completely drugged I don’t know whether you BOTH raped me or 1 of you did & you later laughed about it the next morning saying we [me & 3 girls] were so drunk we kept blacking out but nasidlwegula.”

He said the woman later tweeted: “Just so you know? I was a virgin when y’all did that to me.”

Sikwane claims that the allegations gained momentum on social media which resulted in his dismissal by radio station 947 FM.

He further argued that the tweets were without merit and lacked the truth with the sole purpose of injuring his reputation.

“The said words, as contained in the tweets, are false, wrongful and defamatory of the plaintiff, in that they were intended and will be understood by the readers to have the following meanings: the plaintiff has committed the heinous crime of rape, the plaintiff drugs and intoxicates women in an attempt to engage in sexual intercourse with the said women … laughs and finds it amusing that young men get drunk and black out … is a criminal who commits crimes against women … has conducted himself improperly … is unworthy of holding himself out as an honest, moral, ethical and/or competent person…” noted the court papers.

Sikwane said he did not wish to benefit from the R500 000 claim, but he would donate the money to the feminist women’s rights organization People Opposing Women Abuse.

His lawyers are reported to be opposed to the matter being referred for external mediation.

A court date has not yet been set for the hearing.

Yesterday, DJ Fresh dropped his brand new EP titled Voice of Hope on all digital platforms. He also revealed his gig guide which consisted of more than 6 gigs for this weekend only. One of his stops includes Rockets in Menlyn, Pretoria. This comes after his highly anticipated interview with Mac G and Sol on Podcast And Chill.

During their sit down, Mac G claimed that DJ Fresh has all the money in the world and according to the Big Dawg, that is far from true.

“I don’t have all the money in the world. I was laughing the other day about how people talk about we are using our influence for this. You know if I had half the influence people think I do. And it’s simple and there is a system and we will use the system to prove our innocence.

“I wish I had one judge on my speed dial. I don’t even have a judge on my speed dial. In fact, let me tell you. When this ish started. You know we had about four or five people call us saying they are cops and they can make this thing go away. They just need twenty thousand. I was like, I’m not going to pay you to make something go away that didn’t happen. Because that would be me admitting that we’ve done something wrong. I’ve done nothing wrong. I’ve got nothing to hide and in fact if it goes to court. There’s more than enough evidence to show you that I was never in Pretoria with Themba at any of those places in 2011 in July.” He said.

Following the allegations levelled against him and Themba, Fresh said that he has never forced himself on a woman.

“I think it’s unfortunate that even with all that you mentioned. There’s a whole lot more in the docket that shows that there’s a lot of lies happening here. And I think it doesn’t help that now you have all these influential people backing you saying go open a case. These people must go to jail.

“I’ve been through so many emotions. At some stage, I was very angry. I was like – what have I done to whom that I must go through all of this. At some stage, I even felt sorry for her. That what have you been through that you think it’s okay to do that. And not only willing to do that but perpetuate it. I felt a ton of emotions over the last eight or nine months.” Said the former 5FM DJ in part.

Legendary South African radio personality, DJ Fresh was a guest on Podcast And Chill with Mac G. During the show, he was asked about the rape allegations levelled against him and Euphonik.

Fresh said that he wants the law to take its course.

“I am for if a crime has been committed then let the law take its course. It’s easy to stay behind the computer and accuse people of stuff. But seriously vele it could be anyone and unfortunately we’re in an industry where a lot of people consume alcohol and a lot of sh..t happens. Unfortunately, this event never happened. Do you know what I mean?” He said.

He was in two emotions when the NPA said that they were not going to prosecute.

“In fact, It was sad when the NPA actually. Okay, I was in two emotions when the NPA said they were not going to prosecute. I was happy because you don’t really want to go through a rape trial. Nobody wants to go through a rape trial. But if there isn’t a trial, then it’s in the air for people to decide what they wanna believe. And for me therein lies the problem because if the NPA is saying there is no reasonable prospect of a conviction. It doesn’t mean you didn’t do it. It just means they can’t prove it and for me, that’s a problem. Hence we went the route we were going. That we need to prove that this person is talking rubbish.”

Mac G claimed that Fresh has all the money in the world so he could make a case disappear if he wanted to.

The interview was on Metro FM when the award-winning DJ was still hosting the Fresh’s Breakfast show. HHP was asked to freestyle and he chose a kwaito beat and showcased his artistry leaving many mesmerized by his bars.

The National Prosecuting Authority (NPA) has dismissed the case of crimen injuria opened by Thato “DJ Fresh” Sikwane and DJ Themba “Euphonik” Nkosi in April against an alleged rape victim known on Twitter as Nampree.

In a statement, NPA spokesperson Lumka Mahanjana said they had decided not to prosecute the charge of criminal defamation as they believe there would no possibility of a successful prosecution.

“The NPA can confirm a decision not to institute prosecution based on charges of criminal deformation was taken. The NPA is of the view there are no prospects of a successful criminal prosecution.

“The attorneys have been informed accordingly.”

The two men opened the case against the woman earlier this year after she alleged the DJs had drugged and raped her in 2011 at a chillas (small party) she attended with a friend, who was apparently invited by one of the DJs.

Speaking to a local publication, the woman said she welcomed the decision to drop the case. She said she would be going to jail for simply stating her truth if the NPA decided to prosecute.

“I welcome the decision by the NPA because it declined the case twice, even after they appealed. Should they have not declined, I would have been sentenced. I’d have a criminal records for simply stating my truth,” she said.

The DJs have been mired in controversy after the woman accused them of rape in a post on Twitter.

In an interview , the woman confirmed she had opened a case with the Sunnyside police station on January 13.

In February, the NPA said the rape case against the two DJs had been dismissed due to “insufficient evidence”.

“With regards to the DJs Fresh and Euphonik matter, the docket was presented to the prosecutor. Upon perusal of all the available evidence in the docket, a decision not to prosecute was taken. There are no prospects of successful prosecution on the available evidence because the evidence is insufficient,” Lumka explained.

The National Prosecuting Authority (NPA) has dropped the case of crimen injuria opened by Euphonik (Themba Mbongeni Nkosi) and DJ Fresh (Thato Sikwane) back in April.

The duo opened the case against a woman known by her Twitter handle @nampree, who alleged at the beginning of 2021 the DJs had drugged and raped her in 2011.

She opened a rape case earlier this year but it was subsequently dropped by the NPA due to “insufficient evidence”.

There has been a constant war of words between DJ Fresh, Euphonik and Nampree over the past couple of months and as a result, the DJs opened the crimen injuria case against her, after her case of rape against them was dropped

NPA spokesperson Lumka Mahanjana confirmed the decision not to institute prosecution, ” based on charges of criminal defamation.

“The NPA is of the view that there are no prospects of a successful criminal prosecution. The Attorney’s have been informed accordingly,” she said.

The legal organisation representing Nampree announced earlier on Tuesday, via Twitter, that the NPA had dismissed the DJs’ case.

“We welcome this decision and stand firmly against the use of such charges in silencing victims/survivors,” the tweet read.

Nampree said the NPA’s decision had allowed her to speak out again.

Women who have opened cases or are involved in legal matters against DJ Fresh were happy with the decision made by the NPA.

Radio host Penny Lebyane said their “ancestors heard” their prayers, while controversial poet Ntsiki Mazwai congratulated Nampree.

Penny Lebyane is adamant to get justice as her battle with her ex-boyfriend DJ and media personality DJ Fresh, got dismissed. Penny told a local publication that she only wants her name removed from DJ Fresh’s and Ntsiki Mazwai’s legal battle.

On Instagram, Penny shared parts of the interview she had with a local publication where she says she will no longer be silenced. “I will not be victimized. I will never live in fear again. I was a child now l am grown,” shared Penny.

“I know it’s bigger than me and l will stand cause l understand abuse of power has to be stopped period. The courts of this country can not be used to silence us.”

Penny revealed that her lawyer was bullied and abused so she feels that this battle is no longer hers to fight but also for other women, “My lawyer was bullied and psychologically abused so it’s not about me cause it was never about in the 1st place. I am not tired, l just begun cause our children deserve better. l am my sister’s keeper, l am determined to stand in the gap and face it.”

The interview she shared was that with a local publication where she revealed that DJ Fresh allegedly demands her to pay for his legal fees which amount to R79000, according to the publication. Penny is set on not giving the DJ a cent of her money and is gearing up to fight him – in court.

After her case was dismissed, Penny reportedly applied yet again at the Johannesburg High Court to continue this fight, and find answers as to what her involvement between Fresh’s and Ntsiki’s battle is.

“The fact is that I am not paying you a cent, you will never see a penny from me,” she said. “I must pay my hard-earned cash that I work for my children? No. I wanted to know how the system works because if you are going to put me in a court document, it means the only way I can get answers is in court,” she told the publication.

She then added that the courts have no informed her of her wrongdoing so she wants answers as to why was she mentioned in the first place. She then takes it back to the time she was allegedly abused by DJ Fresh whilst they were dating almost 2 decades ago.

DJ Fresh told the publication that Penny can do whatever she wants and if she wants to be in contempt of court, he does not care. “All this is very rich coming from someone that posted lies and bullshit about me on Twitter,” Fresh responded to the publication when asked about this battle.

Her involvement on the case is because Fresh alleged that Penny was the original author of a post which ousted him as an abuser. This post was then shared by media personality Ntsiki Mazwai, who was then dragged to court.

Ntsiki has not said anything about the case ever since and has remained silent. This after the court ruled in favour of DJ Fresh.

Former radio broadcaster Thato “DJ Fresh” Sikwane has obtained a court order interdicting and restraining poet/musician Ntsiki Mazwai from mentioning him in a defamatory manner.

According to a court judgment, Sikwane was granted a request to remove his name from voracious tweeter Mazwai’s keyboard following a year-long court battle.

Sikwane dragged Mazwai to the Johannesburg High Court to force her to refrain from publishing statements alluding to him being an alleged rapist.

Mazwai, following momentum in the #MeToo and #SueUsAll movements, posted a tweet that originated from Facebook by a user named Swazi, who alleged that Sikwane forced himself on her at Montecasino, Johannesburg, 17 years ago.

The post, which was widely circulated on social media at the time, mentioned the names of other male public figures.

In the judgment, which was handed down in March but only came to light recently, Mazwai’s post was found to have been defamatory. The judgment also ordered Mazwai not to make copies of the application or leak them to third parties.

“The respondent failed to address the applicant’s allegations that she did not retweet a post from Facebook, but rather she took the original post from Facebook, added malicious comments by referring to the applicant as a rapist and further comments, and posted it on Twitter, thereby creating a brand-new post, which statement is derogatory and defamatory,” the order reads.

Mazwai argued that she simply retweeted a post that had existed on Facebook since 2019 and had already been seen by thousands of people. However, the court found that “the respondent’s allegations that she merely retweeted the Facebook post does not entitle the respondent to publish defamatory allegations about the applicant”.

“She evidenced reckless indifference as to whether the post was true or not. Under the repetition rule, a person who repeats a defamatory allegation made by another is treated as if they made the allegations themselves, even if they attempt to distance themselves from the allegation.

“If one has regard to the original Facebook post, nowhere does it state that the applicant is a rapist and has abused his position as an influential public figure. It is evident that the respondent proceeded to repost the Facebook post by adding her own content thereto.

“The respondent does not deny adding content to the Facebook post before retweeting it,” the judgment reads.

The uWrongo hitmaker was, however, not asked to apologize or afford Sikwane any damages as the court stated that Sikwane had not asked for either in his application.

The court order granted Sikwane his wish to not be named by the star intentionally or unintentionally in relation to allegations of rape.

However, it also granted Mazwai the right to post about the star under lawful circumstances.

“The order requested in its current form is too broad and cannot be granted as it unreasonably restricts the respondent’s right to freedom of expression enshrined in section 16 of the Constitution.

“The respondent may be justified in posting/tweeting and/or retweeting information about the applicant in the future under lawful circumstances, and thus a blanket prohibition would be unwarranted. The respondent cannot be prevented from making any comment that may defame the applicant or damage his right to dignity,” the judgment reads.

Mazwai was also ordered to pay Sikwane’s legal fees.

Mazwai, a gender-based violence activist, declined to comment on the matter.

She previously shared her excitement following the conclusion of the case.

“I have been blessed with miracles through my storm. I would like to thank everyone who has helped with my legal bills. I don’t know how to thank you enough for relieving me of such anxiety. Thank you,” she wrote.

Sikwane said he got what he wanted.

“The judge has limited the relief we sought, but he has given us substantive relief and costs on a punitive scale. That’s more than enough, and the judgment speaks for itself,” he said yesterday.

“I never demanded an apology because it would never be genuine.

“For the record, I have never tried to gag anyone. As [Judge Brian Spilg] said in the initial judgment against Mazwai, being an activist comes with massive responsibility. You can’t just post things recklessly in the name of activism. It’s laughable to accuse someone of gagging you when all that is asked of you is to not be reckless in what you post.”

In just a space of a few months, two women had accused DJ Fresh of rape. That was five months ago but social media will not let DJ Fresh rest until the alleged victims get their fair share of justice.

The radio DJ who lost his job at 947 after the allegations were first brought to light, wished the Economic Freedom Fighters (EFF) a blissful 8th birthday. The political party re-posted the DJ’s wish and they received some backlash for doing such.

The political party re-posted numerous birthday wishes from prominent figures but Fresh’s message received mixed reactions as they were accused of giving an alleged rapist a platform.

In his mother tongue, Fresh congratulated EFF for all that they have achieved in the their short reign.

Many angered Tweeps slammed the EFF for even putting the birthday wish on their page and some threatened to report their page.

The rape scandal started when a woman by the name of Nampree accused the DJ Fresh and his friend Euphonik of rape. The alleged incident happened in 2011 at a hotel with the accuser and her friends. She also added that they drugged her but Fresh said he does not knot the woman who surname is Madikizela.

“This is all so weird having to explain myself about a person I don’t even know!!!” and has now revealed that the family actually contacted him…the same family he tweeted about not knowing weeks back.

He replied to a tweet of someone who called Madikizela a pathological liar and tweeted yesterday: “Aunt of hers called me 3 weeks ago stating EXACTLY THIS!!!She wouldn’t speak on the record coz “family.”

The National Prosecuting Authority (NPA) dropped the case in February as there was insufficient evidence to prosecute the DJs. Still, to many this does not prove that the DJs did not commit the crime therefore they want them cancelled.

It does not end there, a second woman this year accused Fresh of raping her whilst she was till in high school. The woman @TheKingsTings has in a series of tweets, outed Fresh for this serious crime. It gets more confusing, she also claimed to have living proof.

“I hope they come for me. Cause I have the institutional backing (and also living proof to back it up) but I’ve been aware of DJ Fresh as a predator since I was in late high school. I just didn’t have the language to call it rape then,” she said.

“I know Fresh follows me. I would like you to sue me. I have a lot of things to say that I can only be protected in saying once you bring the matter to a court of law. But I know like you know that your victims are many. And some of them birthed proof of your abuse.”

She had since deleted her tweets.

It is not know if this accusation landed in court or not, as Fresh had not said anything relating to the incident.
