A bitter court battle is gradually unfolding in the Johannesburg High Court, involving renowned actress Terry Pheto and children’s toys retailer Greenbean Learning Resources for more than R500 000 that was allegedly lent to her and a business associate four years ago.

The retailer initially instituted legal action for two claims in September last year at the same court, citing that Pheto and another well-known actress and her friend Mampho Brescia refused to honour an agreement to repay amounts of R485 856.88 and R163 348.08, which were start-up costs for a business identified as Let’s Learn Toys.

But the actress says she is ready to defend herself.

“The claims are in their entirety frivolous and vexatious, and we are defending the claims. We have a very strong and unassailable defence to these claims. The matter is in the hands of our lawyer,” she said.

The Academy Award-winning actress subsequently filed a notice to defend the claim in April, disputing the amounts and prompting the matter to be set down for a hearing at the same court on a date still to be determined.

According to the combined summons filed by Greenbean Learning Resources, Pheto and Brescia are in breach of an oral and partly written agreement entered into in May 2017.

“The plaintiff would make payment of the advance in multiple payments as and when required by the company, and these payments would occur either directly to the defendants [Pheto and Brescia] for use in the company, or the plaintiff would pay a supplier or vendor on behalf of the company at the defendants’ special instance request.

“Greenbean Learning Resources would provide the two with stock on consignment, which would be sold by the company on Takealot on their behalf,” read the summons.

The court papers said the agreement stipulated that the proceeds of the sales of the consignment would be used to reimburse the retailer.

“Despite the consignment of stock having been sold by the duo, alternatively, the company [Let’s Learn Toys] failed and/or refused to make payment to Greenbean Learning Resources.”

The papers added that Pheto and Brescia disputed the existence of a contract between the parties.

However, according to a sworn affidavit deposed by Greenbean Learning Resources chief executive Lesley Kekana, the company is in possession of documents and invoices that confirm the existence of a written agreement.

Pheto disputed the validity of the documents, which were mainly invoices, through a special plea affidavit.

“There was no agreement between the plaintiff and the defendants, and therefore there was no material … At no point did the plaintiff make advanced amounts to the defendants.

“The defendants deny requesting the plaintiff to make payments on behalf of the company to suppliers…

“The plaintiff has not provided the defendants with any consignment of stock to sell on behalf of the company on Takealot,” reads her answering plea.

Pheto said that the Johannesburg-based retailer had failed to provide proof of the loan agreement.

She asked the court to dismiss the application with costs.

Tloledi told Daily Sun she’d suffered since 2006, knowing she would never hear her music being played by the state broadcaster.

The 50-year-old from Polokwane in Limpopo said as a final attempt to get answers, she decided to camp outside the Union Buildings in Tshwane. “The only job I know is music. I recorded my first album in 1998 and it did well. My tracks were played on SABC and my second album did well too,” she said.

Tloledi alleged in 2006, the SABC changed the sound of her music and destroyed her career when she complained. She said she wanted government to provide her with a lawyer to take on the broadcaster.

“Since 2006, I have been suffering without any income. After my husband died in 2014, I lost everything,” she said.

Tloledi said she was homeless and had to beg for food from family and neighbours.

“In 2016 when we were in parliament for a hearing, the SABC promised to give musicians money, but I was excluded because I have a case against them,” she said.

“In November 2016, they promised parliament they will pay me R100 000 and provide a recording studio to record my new album.”

Tloledi said she had many songs to record. “I am appealing to music producers like Pastor Benjamin Dube to give me a chance because his style of music is like mine.”

Group executive for corporate affairs and marketing Gugu Ntuli said: “The SABC can confirm there is no record of such a decision.

“The corporation would also like to encourage the concerned to contact the SABC directly if there is any query from their side.”

“Friends and Family, unfortunately my little brother, Thapelo, left us in the early hours of today. Please give my family and I some space to process and arrange everything. Thank you, loves,” wrote Kamo.

She did not announce the cause of death, but said he was supposed to celebrate his birthday with his family, which didn’t happen. Thapelo would’ve turned 25 on Monday, 25 October.

Kamo wrote: “What pains me the most is he never spends his birthday at home. This year he assured my mom he was going be home for his birthday. Unfortunately, he didn’t make it. He left us on the eve of his birthday.”

On Monday, she posted photos of him to wish him a happy birthday.

“We were supposed to be celebrating your 25th birthday today, Sthape! I’m so sorry, Nana. I’m so sorry. Happy heavenly crown birthday my boy. I love you so much. I’m sorry, papa,” she wrote.

Fans of the young actor have sent messages of love and condolences to Kamo and her family.

A former Kwazulu-Natal police commissioner who is facing fraud charges in relation to a R47-million police tender has dragged Police Minister Bheki Cele into the scandal, accusing the former national commissioner of being the one who signed off on the alleged fraudulent contract.

In her application for financial assistance, received by the SAPS on Thursday and seen by the publication, former Kwazulu-natal commissioner Mmamonnye Ngobeni has for the first time linked Cele to the multimillion-rand contract that went to controversial Durban businessman Thoshan Panday in 2010.

The contract was awarded to Panday’s company, Goldcoast Trading, for the accommodation of police officers during the entire 2010 World Cup. The matter is now a subject of a fraud and corruption case before the Durban magistrate’s court. In October last year, Ngobeni, Panday, and two others appeared before the same court on multiple counts of corruption following their arrest.

Ngobeni is accused of being an “accessory after the fact” in that Panday allegedly paid for her husband’s birthday party in 2010 after he was awarded the tender. She has also been charged with defeating the ends of justice following allegations that she tried to stop former Hawks KZN boss Johan Booysen from investigating the contract.

Ngobeni and Ashwin Narainpershad, a former policeman, were granted R20 000 and R10 000, respectively. Panday, a close associate of former president Jacob Zuma, and Colonel Navin Madhoe, who was stationed at the KZN supply chain management, are also out on bail of R100 000 and R10 000, respectively.

It has now emerged in her application that Ngobeni is pointing a finger squarely at Cele’s in his capacity as the SAPS final accounting officer at the time the tender was signed off. Cele was police commissioner before he was dismissed from the position by Zuma in 2012, after his role into alleged police property lease deal, which was found to have been irregular by former public protector Thuli Madonsela.

Ngobeni, who is arguing that the state must help her pay for her lawyers as she was in the employment of the SAPS at the time of the alleged crime, says “the 2010 procurement was approved at the head office and not by the province”.

“The bid committee also was at the head office in Pretoria. At no point was I involved in those matters and there is no paper trail to that effect,” said Ngobeni.

“The national commissioner, General Bheki Cele, approved as per attached document. At no stage did I stop or attempt to. There has always been a ploy to remove me from office.”

Ngobeni has attached to her application proof of Cele’s signature on the deal and another letter from the National Prosecuting Authority and the specialized commercial crimes court letters declining to prosecute her based on insufficient evidence and “improper investigative techniques”.

Police spokesperson Vish Naidoo said: “We received the application, and it is still being processed.” Ngobeni could not be reached for comment while Cele had not responded at the time of printing.

Ngobeni’s application comes at a time when the relationship between Sitole and Cele is at an all-time low. Ngobeni is seen as a former ally of Cele and approval of the legal assistance could be interpreted as Sitole helping her to throw the minister under the bus.

Earlier this month, President Cyril Ramaphosa instituted a board of inquiry into Sitole, which had been demanded by Cele. This followed months of a protracted battle over the control of the police force. Ramaphosa has since asked Sitole to make representations on why he should not be suspended. In his representations, Sitole said Cele has made him a target as he partly blamed the minister for the unrest in July, because of his alleged delay in approving the police budgets for crime intelligence. Cele did not answer specific questions.

His spokesperson Lirandzu Themba said: “The minister is not aware of the allegations nor is he aware of the legal assistance you refer to. This would usually be handled by the office of the national commissioner.”

Afro-soul singer Bulelwa Mkutukana, best known by her stage name Zahara could face jail time after a warrant for her arrest was issued on Friday.

The warrant was issued by the Johannesburg Commercial Crimes Court sitting in Palm Ridge Magistrate’s Court after she failed to show up to answer to a charge of failing to submit her personal tax returns.

The Umthwalo Wam hitmaker was charged by the National Prosecuting Authority (NPA) early this year for contravening South African tax laws for failing to submit her personal tax returns for 2017 and 2018 to the South African Revenue Service (Sars).

She appeared in the same court last month and the matter was postponed to Friday last week where she was supposed to plead to the charge and possibly begin the trial.

But the Phendula singer cocked a snook at the court when she failed to appear for apparently no plausible reason and as a result, a warrant for her arrest was immediately issued. But its execution was stayed until Wednesday, October 27.

NPA South Gauteng spokesperson Phindi Mjonondwane confirmed that a warrant of arrest had been issued against the Loliwe crooner.

“We can confirm that a warrant of arrest has been issued for Bulelwa “Zahara” Mtukukana for her failure to appear in the Johannesburg Commercial Crimes Court sitting in Palm Ridge on her charge of failing to submit her personal tax returns. But it was held over until Wednesday October 27,” she said.

The warrant of arrest was issued a month after the songstress recorded her second criminal record after paying an admission of guilt fine of R2 000 for failing to submit her company Zahara Army’s income tax returns after pleading guilty to the charges.

She paid the fine when she appeared in the same court after the NPA charged her in her capacity as the director of her company, Zahara Army Projects (Pty) Ltd, for failing to submit company tax returns for 2017 and 2018 to Sars.

After paying the fine, the case was removed from the court roll.

Mjonondwana said the NPA welcomed the outcome of the case involving her failure to submit her company’s tax returns as that would send a strong message to would-be tax dodgers that no one was immune from tax compliance and that all people were equal before the law.

Zahara recorded her first criminal record when she paid a R1 500 guilt fine for failing to appear in the same court for the same case in June.

This after the court gave her an option to pay the quantum or spend three months in jail after finding her guilty of contempt of court.

The musician, whose career has taken a nosedive and has been struggling to pay her bills, handed herself over to the police after a warrant of arrest was issued in April against her.
