Former Idols SA judge, Unathi Nkayi sues Kaya FM for unfair dismissal

Radio and television presenter Unathi Nkayi is demanding a whopping R1.6-million from Kaya FM for unfair dismissal and loss of income after she lost lucrative endorsements as a result of the station‘s unlawful termination of her contract.

Nkayi’s demands are contained in the suit she filed at the Johannesburg High Court last week.

Unathi signed a contract with the station on February 11 2020 to be its presenter.

The contract included among others, presenting the Monday to Thursday 12pm-3pm show and “providing Sui generis – [sic] content daily, making 12 public appearances (taking the form of marketing and branding opportunities) on behalf of the defendant at no additional fee for the duration of the agreement.

She also had to collect and produce all audio content and complete entries for the station’s radio awards, and “take responsibility” for all website content and interactions on social media during the course of the show.

Nkayi said, for her contribution, the station was expected to pay her R60 0000 per month from March 1 2020 to June 30 2020.

She said the agreement stipulated that the contract would be terminated if she committed any single material or persistent breach of its provisions.

This includes deliberately neglecting the discharge of her duties under the agreement.

“If she contravenes the regulations repeatedly or in a material manner that jeopardises the station, alienates listeners and/or advertisers, and if she was guilty of any other conduct that would justify summary cancellation at common law,” read the papers.

Nkayi said the station increased her monthly fee to R81 250 after increasing her weekly shifts from April 1 2021 to air the midday show, which was followed by a show presented by Sizwe Dhlomo, from Monday to Friday.

On October 18 2021, she said, she was involved in a verbal altercation with Dhlomo, after reacting negatively to her complaint that he had arrived late for his show, thus preventing her from concluding her shift.

Nkayi said she was humiliated and felt insulted by Dhlomo’s response to her complaint.

Accordingly, she said, on October 19 2021, she filed a complaint to the station’s head of human resources department against Dhlomo.

“The defendant investigated the plaintiff’s complaint and, on 21 October 2021, dismissed it.
In dismissing the plaintiff’s complaint, the defendant requested the plaintiff to tender a written apology to Dhlomo within five days of the date of the letter.”

She said despite complying with the station’s request, the station accused her of failing to do so and indicated its intention to terminate her contract.

She said at the station’s invitation, she made detailed submissions as to why the agreement should not be cancelled.

“On 17 November 2021, the defendant repudiated the agreement by unlawfully purporting to terminate it.

“The defendant’s purported termination of the agreement was unlawful because the defendant failed to give the plaintiff the opportunity to rectify the alleged breach as required by the agreement,” read the papers.

Nkayi said she did not commit any single material or persistent breach of the provisions of the agreement and did not deliberately neglect the discharge of her duties under the agreement.

Also, she said, she did not contravene “the regulations” repeatedly or in a material manner that jeopardised Kaya FM, alienated listeners and advertisers.

She added that she was also not guilty of any other conduct that would justify summary cancellation at common law.

“As a result of the defendant’s unlawful repudiation of the agreement, the plaintiff suffered contractual damages in an amount of R1 300 000.00,” read the papers.

Nkayi said fashion magazine GQ and KFC, which had offered to pay her R30 000 and R70 000, respectively for services relating to her public persona severed ties with her.

After he dismissal, she said, the station did not pay her salary for 16 months.

“The total sum which the defendant failed to pay over the 16-month period was R1 300 000.00 [R81 250.00 multiplied by 16]. Despite demand, the defendant has failed to pay to the plaintiff the sum of R1 300 000.00. The defendant is ordered to pay to the plaintiff the sum of R1 300 000.00,” read the papers.

Nkayi also said the station published defamatory statement on its website, saying that she has been “pink slipped”.

The statement, among others, said there was a breakdown in trust between them and her version of events in the matter and had “unfortunately been found wanting”.

She demands that the station removes the statement from the website and pay her a total of R100 000.

She is also demanding R200 000 for impairment of dignity after the station stated in its termination letter written on November 17 2021 that, acting with pre-meditation, she fabricated a complaint about Dhlomo, which she knew to be a lie, to prejudice his contract with it.

It also stated that her conduct “was a well-thought out plan”, maliciously made a complaint about Dhlomo, connivingly sought to coax other employees to concur with her alleged misrepresentation, lied about her version of events, professed to champion causes against abuse but was abusive towards Dhlomo by falsely accusing him.

The station also said she played the victim and was prepared to use falsehoods and subterfuge to perpetrate a false narrative against Dhlomo and victimise him.

Troubled businessperson Edwin Sodi’s estranged wife Nthateng Lerata has sought to enforce a settlement agreement after the mogul apparently failed to pay her nearly R30 million for her part in the construction of his business empire while they were together.

Lerata, who is also thought to have helped other controversial businesspeople create companies, including G5 Group and Blackhead Consulting – which is synonymous with scoring a lucrative government tender to the tune of R44 million – cited in her documents filed at the Johannesburg High Court on March 28 that the settlement agreement was a consequence of various court actions taken by her against Sodi over the past six years.

Her court application also cited his two companies and a person identified as Nhlabanele Ramahlaleroa, who is a trustee of Sodi’s MJS Family Trust, as respondents in the action.

“Pursuant to the settlement agreement, I seek that the respondents make payment to me jointly the sum of R20 million, together with interest at the legal rate from the date when the payment became due, and a sum of R3.6 million, together with interest.

The papers read:

The settlement agreement resolved the various [court] actions and applications which were instituted between me and the respondents.

She stated that Sodi had agreed to pay her monthly instalments of R200 000 until the amount of R20 million had been settled. She alleged that he had also failed to fulfil his obligation to pay R10 000 a month for child maintenance.

“In the circumstances and having regard to the respondents’ conduct in failing to honour their obligations in terms of the settlement agreement, I seek to enforce [that] agreement by way of seeking payment by the respondents to me.

“At the outset, I point out that, when the respondents failed to comply with their obligations in terms of the settlement agreement, I was of the view that such conduct amounted to a repudiation of [that] agreement,” read her court papers.

She cited that she had been in a bitter legal dispute with Sodi since August 2016, when she had lodged her first court application, which subsequently led to a court order in 2021 instructing him to fulfil his financial obligations towards their settlement. However, the court order had been breached.

“On January 14 2022, on my instructions, my attorney of record addressed a letter to the respondents’ attorney, demanding payment of the outstanding payments due in terms of the settlement agreement.

Her papers read:

The letter was successfully transmitted to the respondents’ attorneys of record. The respondents failed to make payment.

Lerata further stated that, in February, she had sought to have Sodi held in contempt of court for his alleged failure to honour the court order.

“In their answering affidavit, the respondents maintained that they were not in contempt of the court order, as the dispute between us had been extinguished by the terms of the settlement agreement.

“They further advanced the argument that, since I had withdrawn the proceedings, pursuant to the entering into of the settlement agreement, no further payments arising out of the court order could be relied upon,” read her court papers.

She also asked the court to order Sodi to pay the costs of the application.

In March last year, he handed himself over to the Sandton Police Station for allegedly assaulting Lerata.

He had allegedly arrived at her house with a handgun and had found his estranged wife with a male friend of hers. He reportedly pointed the firearm at the friend and tried to shoot, but the weapon jammed. Sodi had then fled the house.

He subsequently appeared in the Randburg Magistrates’ Court after being charged with attempted murder. He was released on R150 000 bail.

He is also facing corruption charges alongside suspended ANC secretary-general Ace Magashule, who is alleged to have benefited from a multimillion-rand tender in the Free State.

His company, along with Diamond Hill Trading (owned by the late businessperson Ignatius “Igo” Mpambani), was awarded the tender to remove asbestos roofs in the province.

By the time of going to print, neither Sodi nor Lerata had responded to requests for comment.

Recently, he warned the South African Police Service (SAPS) to not mess things up when getting to AKA’s killers.

The Megacy also sent a letter directed at the police and the president asking for justice to be served.

“The murder of AKA was fully captured on CCTV, and there were many witnesses, yet, over six weeks later, the police have not made any arrests. The fact that there is a satellite police station right next to the restaurant at which the two were murdered and that the murderers can be seen on CCTV running past that station after the murders is an indictment on the police,” wrote the Megacy members.

“According to the latest data, about 82 people are murdered in South Africa every day. That means since AKA’s murder, about 3444 people have been murdered in South Africa. Mr. President, if the police are not able to solve a murder case captured on CCTV, what hope is there that they will be able to solve all these murders, most of which do not have readily available leads or evidence as the AKA one?”

“Can you, with conviction, say you are satisfied with the performance of the Police Minister?”

“AKA was not just an artist, he was a patriot. He cared deeply about South Africa and performed, almost always, with the South African flag around his mic. The least South Africa can do for him right now is to ensure that his murderers are put behind bars,” the letter states.

As such, he began the rollout for the album through attempting “unconventional” releases. First, it was the surprise release of his lead single Put Your Hands Up. While Cassper suggested on social media that the single was instrumental in reviving Hip-Hop as it did initially climb the Apple Music charts. Anyone who can say they remember the song today, is clearly a Cassper fan.

However, in light of the increasing criticism, it seems that Cassper got serious about producing a hit and it seems that his fans seem to believe that Nyovest might have a hit this time around.

Now it seems that Cassper is ready to reveal what he was working on during his music workshop. This comes after his recent performance where he shared a snippet of the new music he was working on. As promised, it is Hip-Hop and it seems that Cassper is readying another Hip-Hop classic.

This comes after snippets of the track loosely titled Bashimane Baka has been touted as an upcoming hit by Cassper’s fans. This a believable sentiment when considering the track’s lyricism that sees Cassper infusing Kwaito elements in his upcoming single as he dabbles in isiZulu rhymes.

Currently, it is unclear when the single is actually scheduled for release. However, one aspect that Cassper will not have to worry about if the single and subsequent album is a hit, is comparisons to his late music arch-nemesis AKA.

Minnie Dlamini has been on the promotional trail for her current rom-com feature film debut The Honeymoon. Even ahead of the premiere of the film, Minnie had conducted an interview on 94.7 with Relebogile Mabotja. During the interview, Relebogile asked Minnie what was the real reason behind her divorce.

Unfortunately, while Relebogile’s question was direct, Minnie’s response to the question left many asking, “What?” This is as Minnie seemed to enjoy the scenic route to answering the question as she did not share exactly why the marriage had to end.

Instead, she blamed the end of her marriage on having married Mr. Jones at 26 years old, which she now thinks was too young of an age to marry. As such, it seems that Minnie was trying to explain that she got married when she did not know who she was, and marriage further complicated that journey for her.

But given how roundabout Minnie went to answer the question, when the podcast episode landed on social media. It is safe to say that tweeps and cyberbullies were dragging Minnie for filth as they suggested that her inability to directly answer a question could do with the allegations of Minnie’s promiscuity during her marriage, which she has denied in the past.
