Controversial record label Ambitiouz Entertainment suffered yet another legal blow after losing a court appeal against music duo Blaq Diamond on Friday. The label was also ordered to pay costs of the court application by the Johannesburg High Court. Even though the loss marks a third court defeat conceded by the record label in a fight to release the talented duo from its stable, it remains to be seen if Blaq Diamond will be able to publish their music on their YouTube channel going forward.

In July, Blaq Diamond successfully interdicted Ambitiouz Entertainment and YouTube from removing their music on the video sharing site and other digital platforms. After seeing victory in court, the group could not release new music after their previous record label appealed the ruling. The appeal was heard in court on Friday, with the duo being represented by legal eagle advocate Tembeka Ngcukaitobi.
The appeal judgment read: “The application for leave to appeal is dismissed. The applicant is to pay the costs of the application for leave to appeal.”

The duo’s lawyer Jade Naidoo said: “Congratulations to my client Blaq Diamond for winning against Ambitiouz Entertainment for the third time! Ambitiouz’s leave to appeal is dismissed with costs! Round three in the bag.”

Ambitiouz Entertainment was exposed by a number of its former musicians, including Malome Vector, Fifi Cooper, Intaba Yase Dubai, and Blaq Diamond, for being exploitive and frustrating them after leaving the label by removing their music from streaming sites and claiming copyright of their songs.

Blaq Diamond, which is made up of Siphelele Dunywa and Ndumiso Mdletshe, filed an urgent court application at the court in October last year after the record label removed their hit song Qoma, featuring Big Zulu, from YouTube, claiming copyright of the song.

In court papers filed in response, Ambitiouz Entertainment boss Kgosi Mahumapelo said the musicians created a problem when they breached the agreement they signed with his stable. He said the sensations, which were relatively obscure, signed a record deal with his stable in 2017.

He said the label had dedicated time, energy, resources and substantial amount of capital to initiate the group’s launch with the expectation of receiving a return on investment when they released three albums.
“The applicants, Blaq Diamond, did not fulfil their obligations to release these albums. Instead they terminated their agreements with the second respondents in an unlawful manner. Furthermore, without waiting for the court ruling confirming the valid termination of the agreement, they proceeded to enter into a new agreement with a different record label,” the court papers read.

Siphelele Dunywa has revealed he and his bandmate Ndumiso Mdletshe are set to launch a record label. After Blaq Diamond recently won their case to interdict Ambitiouz Entertainment from removing their music from YouTube and all digital streaming platforms (DSPs), they are now gearing up to unveil their entity called, uMuthi Othithi.

During the duo’s sit-down on Podcast and Chill, the Summer Yomuthi hitmakers said they parted ways with the record label in December 2021 to grow a bigger market.

“It feels great to be independent. I’m in love with the challenges because I’m learning a lot, how to run my schedule daily, and how to separate music from business. I’m thankful that we met Ambitiouz [Entertainment], now we are lucky to be independent and move forward,” Siphelele told TshisaLIVE.

Siphelele said they had a wide range of fresh artists they were signing under their record label and wanted to make sure they empowered them so they were ready to grow as artists.

“We have different artists from high school, different cities … I just can’t wait for people to hear the new talent. We need to teach one another, that this is generational, you take one person and build them — and once they are successful, they will build another artist.

“More than anything, I want to see the people that we are signing right now start their record labels one day and sign themselves because as an artist you need freedom, to do whatever you want.”

In May singer Sbahle took to her timeline airing grievances about Blaq Diamond, saying they promised to assist with her music career but failed to keep their end of the bargain.

Speaking on their relationship now, Siphelele said they were now on good terms.

“She is an active woman, a hard worker, and we are still on good terms. She is now doing her own thing. It’s always love when we meet her.”

“Right now we are working on an album, we have so many artists we want to introduce. Whatever music we do, we heal the people.”

Angel — who has over 210 000 Instagram followers — is also a musician. She has a hit song titlef Uzongkhumbula featuring TNS and Mpumi.

Blaq Diamond lost to their former record label, Ambitiouz Entertainment after the high court in Johannesburg dismissed an application for an urgent court interdict to stop the label from taking down their music videos on YouTube.

The record label claimed ownership of the copyright of the music videos, saying the artists had no right to submit them to YouTube without its permission or consent. The SA duo claim that the deletion of the videos from the streaming platform will affect their monthly income, which is a minimum of R30 000.

“The unlawful takedown infringes upon the applicants’ rights,” read the papers.

“After having read the papers filed on record and after having listened to counsel, an order in the following terms is made. The matter is struck off the court roll for lack of urgency. Each party to pay their own costs,” reads the judgment.

Blaq Diamond’s legal representative Michael Matlapeng confirmed that the court has struck their application off the roll. “We will enrol the matter on the normal court roll for a judicial termination of the three contracts,” said Matlapeng.

It was also revealed by their legal representatives that the duo haven’t received royalties since 2017.

Pop duo, Blaq Diamond has been accused of allegedly failing to settling their bill at The Pavilion Lounge last night.

The news was made known by blogger Musa Khawula stating that the duo felt a little short when it was time to pay off their bill.

However, they had a good time at the lounge but things did not go well for them at the end.

A copy of a receipt from of the bill from last night at The Pavilion Lounge clearly shows that when it was time for the pair to settle their bill, they felt under.

An amount of R8500 00 was due to be paid by Blaq Diamond, however, the pair failed to pay the full account as the credit card details shows on the receipt that the funds were insufficient.

South African Pop duo, Blaq Diamond has announced their departure from the Ambitiouz Entertainment record label.

Ambitiouz Entertainment for years has been a label that has nurtured and brought out great talents and also managed top-tier artists like Amanda Black, Emtee, Sjava, A-Reece, Priddy Ugly, and more.

Unfortunately, their past relationship with other artists and the scandals surrounding their split has left the label with some bad tags which are either financial concerns or some form of issues.

In a recent episode of “Podcast And Chill” with Mac G, the “Summer Yo Muthi” hitmakers revealed they’ve parted ways with Ambitiouz Entertainment and are now fully independent.

According to the duo, their split with Ambitiouz Entertainment was clean without any issues, they further revealed they’ve been away from the label since December 2021 and the move to part ways with the label was inspired by their decision to grow.

According to them, they wanted to break into the African market

“It was between sticking with the label or choosing growth. We wanted growth more than anything because we wanted to tap into the African market. There was a clear disconnect between our vision and theirs. It no longer aligned. It was nice working with them. We just want to go shoot to the other side,” Sphelele said.

The Sama-winning music duo said they signed to the label within 48-hours after award-winning singer Sjava played the song for Ambitiouz Entertainment around the same time A-Reece and other artists were leaving the label.

Blaq Diamond said they are on good terms with the label and would be open to working with them.

“We always made sure we had lawyers around. Even with us leaving Ambitiouz, we had to get lawyers to clear everything up,” they said.

Ndumiso Mdleteshe and Sphelele Dunywa are really private celebrities and have since not confirmed whether they are in a relationship or not. From the look of things, however, Sphelele Dunywa seems to be romantically involved with Kamo Mhela and Ndumiso Mdletshe was or is possibly still dating Cyan Boujee.

Ambitiouz Entertainment record label announced that their artists, Blaq Diamond has a collaboration with American rap star, Jay Z.

Taking to Twitter, the label said, “Blaq Diamond ft Jay-Z……. Loading,,,,,,,,,,,,,,,,,,,,,,”

The tweet has garnered lots of attention as lots of followers believed the label is just chasing clout with the legend.

Few persons believed the news, while others mocked the label, saying they probably meant Jacob Zuma and not Jay Z.

This isn’t the first time a big international artist is collaborating with SA musicians, but this recent news feels like a dream to most of their fans.

However, the music artists are yet to react to the news announced by the South African record label.
