Media personality Dineo Ranaka has refused to hand over several documents and an audio recording of her estranged husband, Klaas Pesha, allegedly assaulting her in a domestic violence tiff that resulted in the collapse of their marriage last year.

The tape was requested by Pesha’s lawyers to prepare for the R500 000 defamation lawsuit he filed against Ranaka at the Joburg high court in June.

Pesha filed the lawsuit after accusing her of “fabricating” the assault allegations against him.

He said he discovered Ranaka’s defamatory statements when she posted them on her Whatsapp status, alleging he had assaulted her in one of their domestic squabbles at their Tshwane home.

Pesha said the Kaya FM breakfast show host said the incident took place seven months after they tied the knot. She immediately dumped him as she could not stand to be with a man she claimed was a perpetrator of gender-based violence.

Her ex-hubby said she stated she would rather file for divorce than be bumped by him.

“I would rather have a divorce decree than [sic] a premature death certificate. I cannot believe I married a man who has the full capability of killing me and making my death look like it’s my own doing,” reads the message.

Pesha said Ranaka’s legion of fans, friends and family were on her contact list when she posted the messages. He further stated that Ranaka made the statements maliciously, knowing they were false because he was never arrested or charged for assaulting her.

His lawyers wrote a letter of demand to Ranaka on October 14 2021, ordering her to retract her status and apologise to him, but she refused. This, he said, left him with no choice but to approach the court for relief.

In her defence, the former YFM and Metro FM presenter insisted Pesha assaulted her while she was holding their three-month-old baby.

She said she had wanted to open a case of assault against him but he threatened to file a counter charge.

After responding she will defend the matter, Pesha’s legal team asked her to produce the audio and the documents to prepare for trial, but Ranaka refused. In her discovery affidavit she submitted in court on August 31 2022, Ranaka said she was indeed in possession of the audio and the documents. “I have in my possession or under the custody and power, the documents or recordings relating to the matters in question in this suit and which can be used in this action, and which tend to prove or disprove either party’s case, which are set forth in the first schedule,” read the affidavit.

“I object to produce the documents set out in the attached [this include] original audio recording of the incident of assault of the defendant by the plaintiff [on] 11 September 2021, copy of protection order by the defendant against the plaintiff [on] 28 September 2021, copy of the travel itinerary of the defendant from Johannesburg to Cape Town and from Cape Town to Johannesburg [on] October 13 and 14.”

A Johannesburg-based lawyer, who did not want to be named, said Pesha’s legal team will write a letter to Ranaka’s lawyers and demand she hands over the audio clip and other documents in her possession because they need them to prepare for trial.

“The trial cannot proceed without Dineo Ranaka handing over audio clip to his [Pesha’s] legal team. The court will not allow that to happen, eventually she will be forced to hand that over to his legal team,” said the lawyer.

Ranaka could not be reached for comment at the time of going to press as she ignored our phone calls and messages sent to her.

Afrobeats musician Moneoa Moshesh-Sowazi’s ex-boyfriend, businessperson Phiwe Maphanga, has allegedly contacted the star to engage in settlement talks in an effort to have her drop a case that she opened against him.

However, the star is adamant that she wants her BMW back and that Maphanga must pay off the debts he left her with, which amount to about R500 000.

Moshesh-Sowazi opened a case of motor vehicle theft under false pretence at the Norwood Police Station in Johannesburg two weeks ago.

On Friday, she alleged that Maphanga, who obtained a protection order against her a fortnight ago, had contacted her through her friend to tell her that he wanted to settle the matter out of court.

She said:
Phiwe’s friend approached my friend, saying that they want to settle. He did not speak to me directly … I am not sure if it was another one of his ploys to get me to drop the case or keep quiet. I don’t know what he is doing, but he still has not returned my car and I don’t know why he is refusing to.

The conversation between the two friends is said to have happened last week.

The musician believed that Maphanga was no longer in possession of the vehicle.

“I just want my car back. It’s not nice not having my car. I highly suspect that he sold my car illegally, and whatever money he made with it laid the foundation for the lifestyle that he is currently living.

“Phiwe likes to undermine me as some struggling singer, and that is what his sister said to me. But I believe that, even with my struggling career, my car laid the foundation for whatever lifestyle he is living today, otherwise where is it?
Where is my car? He has been taking me on a wild goose chase for the past five years and now he is blatantly denying it.

Maphanga allegedly took the car and said that he was going to fix it.

He denied trying to contact the musician. “I am not aware of any settlement. I have not instructed anyone to speak about this,” he said.

Moshesh-Sowazi said she was frustrated by the process. “This is beyond frustrating because I worked hard for my things. I did not grow up rich and never claimed to be rich, but I am working towards not struggling. So, I spent 11 years of my career working hard to meet some guy who turned everything upside down.”

She said Maphanga had not only left her in debt, but also physically, emotionally and spiritually drained.

The businessperson opened a case of intimidation, extortion and defamation of character against Moshesh-Sowazi at the Sandton Police Station two weeks ago.

He also obtained an interim protection order against her after she alleged on her social media platforms that he had scammed and abused her.

In an affidavit for his application of an interim protection order, Maphanga claimed that the posts made by the musician did not only affect him, but also had a negative impact on the lives of his wife, mother and sister.

He claimed that he had been receiving death threats.

He wrote:
As a newlywed and a man with a newborn baby, I feel extremely vulnerable as I am uncertain of the extent to which the threats could be acted upon. I have been giving her money throughout the course of our breakup as she would claim that if I don’t give her money, she would ensure I am in harm’s way

At the time, Moshesh-Sowazi’s lawyer, Buang Jones, said the musician had opened a case of intimidation against two police officers who called her to the Sandton Police Station and asked that she delete her posts about the businessperson

Home affairs minister Aaron Motsoaledi says most Zimbabweans holding now-defunct exemption permits believe the court will rule against the government doing away with their special permits.

Only 4,000 of the about 178,000 holders of the Zimbabwean exemption permits (ZEP) have applied for visas to legalise their stay in SA, prompting the government to extend for six months, to June next year, the grace period to legalise their stay.

Motsoaledi said: “I wouldn’t say they’re showing us the middle finger; I’d say they have been convinced by these court cases that they shouldn’t bother [applying] because they believe this matter is going to be thrown out by the courts.”

Motsoaledi said the organisations taking the department to court were arguing that if a person had stayed for a long time in a country, that country essentially owed that person permanent residency.

“There are those [Zimbabweans] who believe they cannot be thrown out.”

He said that was a worrying trend as the government was not willing to extend the grace period beyond June 30 next year.

A departmental advisory committee set up by Motsoaledi and chaired by Cassius Lubisi to assess the visa applications lodged by affected Zimbabweans recommended that the deadline be extended.

Motsoaledi said he felt obliged to take Lubisi’s advice as three months wouldn’t be enough time to process every affected Zimbabwean national.

“They were looking at the number of those who would still need to come and the fact that we are left with three months and said: ‘No matter if we would work day and night, we wouldn’t finish in three months’,” Motsoaledi said.

“It would have been pointless for me to refuse [the extension] because these are the people who are going to be doing the work.”

On the risk of the decision causing a diplomatic row between the two countries, Motsoaledi said the Zimbabwean government had been engaged about it and understood SA’s stance.

“They understand as they are also running a government,” he said.

“The [Zimbabwean] minister of foreign affairs said they’re putting up structures to welcome whoever comes back home. So it was discussed and we in the beginning also wrote to the ambassador of Zimbabwe through the international relations & co-operation department to explain what is happening.”

Motsoaledi called on affected Zimbabweans to apply and leave everything else to the department and not to worry about whether they would be approved or not.

Meanwhile, low-skilled Zimbabweans in SA say they are unlikely to qualify for visas and believe SA’s decision to do away with the special exemption permit is aimed at pushing them out of the country. They said it therefore made no sense to apply for the visas.

Advocate Gabriel Shumba, chair of the Zimbabwe Exiles’ Forum, said it was “obviously difficult to obtain required documents for a huge number of people”.

“The employer [of affected Zimbabweans] has to undertake to pay your deportation and other costs; many employers refuse to write such letters,” Shumba said.

He said other difficulties included getting certificates from the labour department indicating why a South African wasn’t preferable for the affected job.

Shumba said they believe the migrating of ZEP holders to other visas was merely “a camouflage for deportation”.

Ngqabutho Mabhena, chair of the Zimbabwe Community in SA and the African Diaspora Forum, said most ZEP holders were not applying because it was clear they did not qualify.

“These are people of low skill. Most work as petrol attendants, domestic workers and in other low-paying jobs and this is why so few have submitted their applications,” Mabhena said.

He said even skilled workers such as receptionists, journalists and lawyers were affected as they did not qualify for visas.

The Zimbabwe exemption permits came into being more than 10 years ago when SA experienced an influx of asylum seekers from Sadc countries, with the vast majority being Zimbabweans.

With political odds heavily stacked against him, embattled Deputy President David “DD” Mabuza on Friday thought he might be handed a bargaining chip by the party’s national executive committee (NEC) to revive his ambition to seek re-election into the governing top leadership at the party’s December national conference.

However, in a strange twist of fate, Mabuza’s home province of Mpumalanga yesterday announced that it would not support him for the deputy presidency position after the provincial executive committee (PEC) resolved that it would instead support Justice Minister Ronald Lamola.

Mpumalanga ANC said it had “a frank discussion” with Mabuza on leadership issues following its visit, where it apparently informed him about its leadership preferences.

Despite being snubbed by the PEC, Mabuza, who led the province for two terms before his election to the deputy president position, is said to have indicated his intention to fight on.

Mpumalanga ANC chairperson Mandla Ndlovu said Mabuza had last Friday told him that his future would be decided by branches of the ANC.

“I had a frank talk with comrade Mabuza and we were talking about succession. Comrade Mabuza said that he is waiting for branches to nominate and his is putting his destination in the hands of the branches. He said that he is not that person who would parade himself for positions. The PEC doesn’t nominate candidates as we are not in the status of branches, so we will give branches to nominate their own candidates,” said Ndlovu.

He said tomorrow they would meet with leaders of the ANC’S biggest province Kwazulu Natal to communicate why they have thrown their support behind Ramaphosa and Lamola and also engage their counterparts on the other four positions in the party’s top six leadership.

Until Friday night, several candidates had thrown their hats into the ring for the position of deputy ANC president.

Those candidates include current treasurer-general, who is also acting secretary-general, Paul Mashatile, national executive committee member and Human Settlements Minister Mmamoloko Kubayi, as well as other hopefuls like Eastern Cape premier Oscar Mabuyane.

There has always been a belief in the party that while there was consensus on whether President Cyril Ramaphosa should serve a second term as party leader, the position of his deputy was up for grabs.

An impasse over Mashatile’s constitutional powers in the ANC is what appears to have thrown Mabuza a fighting chance to remain in the organisation’s top six leadership. This is after Ramaphosa’s supporters for the second term elbowed Mashatile from tabling a state of the organisation report at the forthcoming 55th national elective conference in December.

A state of the organisation report is crucial in that it gives an overall current state of the party since its last national conference in 2017. It is also a political and organisational account of developments of the period leading up to the conference, and an assessment of the progress made as well as challenges faced by the ANC and the country.

It was feared by Ramaphosa supporters that Mashatile could use the report to paint a grim picture of the organisation under Ramaphosa, which could have the potential to derail his chances of winning a second term.

In July, Ramaphosa’s supporters successfully thwarted two attempts to evaluate his leadership at the policy conference.

The president’s inner circle – after picking up reports that Mashatile might deliver an organisational report – won a debate that a policy conference would not take the characteristics of a national general council – a mid-term review that allows party members to evaluate the work of the NEC.

The president will, however, still go to the conference limping in the wake of the Phala Phala

scandal, electoral declines since elections in 2019, and the party’s failure to pay staff salaries, among other issues.

After toing and froing, it was decided at this week’s NEC meeting that Mabuza would deliver the organisational report in December. A source close to Mabuza said the deputy president was aware of the many campaigns that seek to oust him.

“He is not resting on his laurels,” the source said.

The lifeline handed to Mabuza came after yet another NEC meeting during which attempts to oust Mashatile as acting secretary were made. During this week’s meeting, Ramaphosa supporters used the party’s constitution as a tool, arguing that it did not make provision for a treasurer general to assume additional duties.

It is understood that Kubayi led the charge against Mashatile, saying it was unconstitutional for Mashatile to act as secretary general. Kubayi argued that the only vacancy that existed in the party’s secretariat was that of the deputy secretary, following the passing away of Jessie Duarte. She said the party’s constitution provided that only the chairperson (Gwede Mantashe) could carry additional tasks.

“Paul and team lost the battle tonight. They never expected we would fight on constitutional prescription,” an NEC member said.

However, an NEC member aligned to Mashatile said his survival of another attempt to oust him was a sign that Ramaphosa no longer had an overwhelming majority of support in the NEC. The Friday NEC meeting also decided that Mashatile would continue working in the office of the secretariat with Gwen Ramokgopa.

“Attempts to get Gwede or Gwen as acting SG have been defeated,” said the member. Gwede says he doesn’t want to go back to HQ (Luthuli House), but if tasked, it can be done,” the leader added.

It was unclear who was going to write the organisational report. Mashatile’s faction was confident that he would have an influence over the document, while Ramaphosa’s backers believed that Ramokgopa would hold sway over the report.

It also remains to be seen if Mabuza will play the role of merely being a “reader” of the report. This came as the Mpumalanga provincial executive committee endorsed Ramaphosa and Lamola to respectively become president and deputy president of the ANC in December.

Mzansi musical artist, Mampintsha was left fuming after trolls body-shamed his wife, Babes Wodumo. A recent picture of Babes not looking like she used to a few years ago, got her trolled by internet users.

This is nothing new, as various pictures of Babes sent trolls into a frenzy and eventually, a trolling parade started.

She was a guest at KZN’s leading radio station, Ukhozi FM, and wore a brown blazer, brown skirt and a cream white polo neck with brown boots. She had a simple hairdo but it was her overall appearance that threw trolls off.

One put a picture of her a few years back and that recent one side by side and the hate just kept on coming.

Not letting the hate get out of hand anymore, her husband Mampintsha took to Instagram and penned a heated message to those haters.

He called them broke and hungry and even offered to hire them so they can get money for themselves.

“It hurts so bad because the people who swear at us are people we do not know. No rich person goes around swearing at other rich people. It’s always those who are hungry that are jealous and practice witchcraft. Whereas they should be using that energy to ask for jobs and I would hire them so they can get money, get laid and stop being angry.

“But they rather spew bile. Listen here, leave us alone. Or I will gladly return you all back to your mother’s wombs, one by one. Our names are not for your entertainment. You guys are very hungry. I’m sorry to my fans, I am very tired of these haters that don’t bath,” he concluded.

The couples reality show Uthando Lodumo returned for a second season and fans got a taste of what the couple has been up to these past few months.

What remains of public interest is the feud between her and her mother I law Zama Gumede.

The two fought publicly and Babes acknowledged that she was wrong for handling the situation the way she did as well.

“I was also wrong. I did all that because I was hurting inside…I’m very heartbroken Not being accepted by my in-laws is painful. Other girls are loved by their mothers-in-law they embrace them. Mine has never embraced me. Instead, I was greeted with a video riddled with profanities,” she said.

Zama on the other hand said she and Babes are not friends and so she must pay damages.

“I was really annoyed. I felt disrespected. You’re my only son and I’m your mother. I deserve to be respected.

Joburg Mayor Mpho Phalatse has given herself 14 days to conclude talks with Eskom on Soweto’s electricity issues.

Phalatse was speaking Saturday at the Soweto Amphitheatre where she addressed residents on their earlier protest memorandum.

Phalatse told residents that Eskom has a clear mandate and she’s ready to act in favour of residents if no action plan is brought forward.

“A relook at the Eskom 60 per cent threshold policy of reconnection, and electricity operational strategy in Soweto and other areas, developing an approach to address illegal connections.”

She said she is disappointed by Eskom’s drive to cut power to defaulting residents.

“We’ve been working with Eskom, and engaging with them for months. In fact, when we came into office, one of my very first issues that I had to contend with as a newly-elected mayor, was the issue of Eskom in Soweto.”

“I understand that Eskom debt in Soweto is a huge problem, however, we must ask ourselves whether this debt is recoverable. I tabled this question to Eskom, and I am yet to receive a response from the Ministers.”

The Soweto community has been facing a number of challenges, including housing issues and unplanned power cuts, which recently sparked a protest to the City’s offices.
