Actor won’t move despite owing rent

Award-winning actor Zolisa Xaluva has allegedly illegally occupied a dead man’s Joburg posh house and is preventing his family from taking occupation.

It seems the traits of his character, the elusive troublemaker, Diamond, in popular TV show The Queen have permeated his real life, according to the family of his deceased landlord, William Alan Nasimith.

The family has reported the matter to the local community policing forum and has also applied for a court order to evict the flamboyant actor from Nasimith’s pad in Willowbrook Estate, Roodepoort.

The startling details are contained in the application submitted at the Joburg High Court for a court order to evict Xaluva by Nico Andrew Theo Botha and Elizabeth Anne Gurovich, who are the executors of the deceased’s estate.

According to the application, seen by Sunday World, Xaluva signed a lease agreement with Jon Rosenberg Estates on June 1 2018 to rent the property from the deceased’s family. Xaluva was expected to pay R9 500 excluding refuse, sewer, water and electricity.

When the lease agreement ended on May 31 last year, the family refused to renew it because Xaluva, who has just joined the new Mzansi Magic show Gomora, had defaulted on his rent and was over R75 000 in arrears. Instead of vacating the property, Xaluva continued to live there without paying.

“The first respondent continuously and throughout the subsistence of the lease agreement failed to effect the payment of monthly rental and ancillary charges due and owing by him in terms of the lease agreement, as and when such amounts became due and owing.

“Upon the termination of the lease agreement on 31 May 2019, the first respondent failed, neglected and or refused to vacate the property in accordance with the notice to vacate issued to him. The first respondent continued to occupy the property such that the lease agreement continued to operate on month-to-month basis subject to the same terms and conditions,” reads the application.

The family lawyers wrote Xaluva a letter on October 11 last year asking him to settle over R75 000 in arrears if he wanted to continue living in the house. The month-tomonth lease agreement was cancelled on October 28 and Xaluva was served with a notice by hand to vacate the property but, again, he refused.

The executors said Xaluva’s refusal to vacate the property financially disadvantaged Naismith’s beneficiaries who depended on the property’s rental income for survival. They also said the beneficiaries are also forced to rent accommodation elsewhere while Xaluva continued to stay there for gratis.

“Due to the continued unlawful occupation of the property by the first respondent, the beneficiaries of the deceased estate are unable to take occupation of the property and are forced to incur expenses in renting accommodation elsewhere.”

Rosenberg also wrote Xaluva a letter in April telling him to vacate the property, but he refused. Responding to Rosenberg, Xaluva wrote in an e-mail, seen by Sunday World: “The owners are ill-informed Jon, they are probably of the opinion you are doing a great Job. I’m not leaving. If the owners wish to engage me, I urge them to contact me or come over and see if they would continue to pay for such living conditions.”

The family lawyer Claire Laurent of SSC Attorneys said the matter was supposed to have been heard on February 3 but was postponed indefinitely as Xaluva couldn’t be served with papers.

“He is evading services,” she said.

TV personality and Homeground presenter Minnie Dlamini’s wedding ring, which was stolen during a robbery, has been replaced.

Dlamini and her photographer husband Quinton Jones reported two different cases of theft and robbery in February last year, during which they claimed that the Mzansi Magic presenter had lost her wedding ring worth more than R200 000, which was partly sponsored by Jenna Clifford, a top-notch jewellery designer.

This week, Dlamini was spotted wearing a bling ring at numerous events, including at work, sparking claims that the ring might have been found.

However, Minnie’s brother and manager Maphe Dlamini said the ring she was spotted flaunting on Instagram was a replacement. He refused to indicate whether insurance company Galileo Financial Services had approved the payout for the luxurious piece of jewellery.

Sunday World reported in February last year that the former Soccer Zone presenter had reported a case of robbery at Randburg police station, stating that robbers had pounced on her and her husband Jones while waiting at a red traffic light in Randburg during the night.

Dlamini had told the police that thugs had threatened her with an unknown sharp object, forced her to open the window and had then robbed them.

According to the police statement, the popular model had also lost her wallet and cellphones during the incident.

A few months later, Dlamini’s husband registered a case in which he claimed he was robbed of items worth R15 000 at a shopping centre.

South African doctors are very concerned about the possible impact of the new corona virus on people with HIV or TB, but there is no data about how these diseases would react to each other.

What is certain is that people with heart disease, lung diseases and diabetes have a higher risk of getting sick and dying as a result of the Covid-19 coronavirus.

According to the Johns Hopkins University in the US, the average fatality rate worldwide is 3.5% of diagnosed patients. Almost 81% of patients have light symptoms, 13.8% are admitted to hospital while 4.7% are critical and end up in the intensive care unit.

Data from nearly 45 000 patients in China, where the Covid-19 outbreak started, show that older patients and those with other illnesses get sicker, with higher fatalities.

According to the China Centre for Disease Control and Prevention, less than 1% of patients younger than 49 die but nearly 15% of those older than 80, 8% of patients aged between 70 and 79 and 3.6% of patients between the ages of 60 and 69, succumb to the disease.

The fatality rate in China is considerably higher for people with underlying diseases, such as heart problems (10.5%), diabetes (7.3%), chronic lung diseases (6.3%), high blood pressure (6%) and cancer (5.6%).

A specialist based in Pretoria said Covid-19 patients with heart problems get sicker because the virus affects the lungs, causing an already weakened heart to work harder to pump blood.

Medical professionals, however, still don’t know if Sars-Cov-2 [the virus that causes the sickness Covid-19] affects the heart muscle itself, as is the case with flu. A further explanation for why people with underlying diseases are worse affected, is the so-called inflammatory storm.

“The immune system response is activated to such a great extent in order to fight the virus that it also begins to attack the patient’s organs,” said the specialist.

According to the American Diabetes Association, people with diabetes are more prone to develop serious symptoms and complications than an average member of the population when they contract the virus. Around 3.5 million South Africans have diabetes. In respect of the possible impact on people living with HIV, experts can only speculate based on how HIV reacts to similar viruses such as flu, said Professor Salim Abdool Karim, director of the Centre for the Aids Programme of Research in South Africa.

Karim said the greatest concern is that there are 2.5 million to 3 million people in South African living with HIV but who don’t take antiretrovirals (ARVs).

“At least 500 000 of them have a low CD4 count [low immunity] and would probably get much sicker if they contracted the new virus,” he said.

“The mortality rate among such patients could be similar to that of the older patients in China.”

Karim based this deduction on the prognosis for these patients when they contract flu. According to a press statement released by the Academy for Science of SA, people living with HIV, who don’t use ARVs, are eight times more likely to end up in hospital with flu than the average member of the population.

The mortality rate among these patients is also three times higher.

However, Karim emphasised that the country’s five million HIVpositive patients who are using ARVs have the same chance of getting flu as any member of the population.

They also don’t become sicker than the average person.

South Africa is also battling one of the worst TB epidemics in the world.

According to the World Health Organisation, there were more than 300 000 TB patients in the country in 2017.

It is estimated that more than half of them are also HIV-positive.

“We are concerned that people with lung diseases are more vulnerable to Sars-CoV-2 ,” said Professor Rob Warren, of the Medical Research Council in Cape Town.

“However, we don’t know what the interaction between TB and Covid-19 is going to be. We also don’t know what’s going to happen if the three pathogens [HIV, TB and Sars-Cov-2] are in the lungs.”

Warren warned that there are many people in South Africa with lowered immunity as a result of underlying diseases as well as other factors – such as a poor diet.

The traditional wedding was preceded by lobola payment by Ndlela’s family and followed by rituals that both families performed to unite the loverbirds.

Kganyago, one of the most sought-after female DJS in the country, couldn’t confirm or deny that she was now the Ndlela makoti. “I don’t discuss my private life with the media, sorry,” she said. Ndlela couldn’t be reached for comment at the time of going to print.

But a family member, who did not want to be named because he doesn’t want to spoil his relationship with the item, confirmed that Kganyago, the former Miss Soweto, got hitched to Ndlela.

He also said the two will walk down the aisle in a lavish wedding billed for the end of the year.

“There is a big wedding being planned towards the end of the year and as a family we are very happy for them and we can’t wait for this big day to arrive,” said the relative.

Another relative who attended the traditional wedding confirmed that Ndlela paid lobola for Kganyago.

“We are officially handing her over to the Ndlelas this weekend in Soweto. Come and see for yourself. We are so excited,” he said.

Kedibuo Moseki from Bodibe Village, outside Lichtenburg in North West, was born on 5 March 1910. Villagers call her Ben 10 because she does things a much younger person would do.

“I’m old but I’m smart. I can remember things and you can’t fool me easily,” she said.

Gogo said when she was young she was a good singer and led a band.

“People used to cry just to hear me sing and watch me dance,” she said, showing off some of her dance moves.

She is not fussy with food but prefers locusts over meat.

“They taste nicer and it was the only meat we had growing up. I still love it, especially the red ones,” she said.

Her husband died 25 years ago, leaving her with eight children and 22 grandchildren.

“Now I have countless great-grandchildren. I’ve lived to see two generations after me and making babies of their own.”

Gogo Kedibuo built her own house.

“It was easy. I only needed help with the roof. I built the foundation and the walls myself,” she said.

“I hear children talk about RDP houses. I don’t have that, but I’m thankful that I have a shelter.”

She didn’t know if God set a time for every human being to die.

“But I don’t feel like I’m going to die anytime soon. I can do everything my grandchildren can do,” she said.

Her son Sekaboshang (76) said: “I’m old and frail but she is still young. I want to bury her instead of her burying me.”

The Department of Health has confirmed that the first South African person under 18 has tested positive for Covid-19.

On Saturday, Health Minister Zweli Mkhize said the 14-year-old from the Western Cape was among 14 new cases who had tested tested positive for the virus. This brings the number of cases in the country to 38.

Earlier on Saturday, the United Herzlia Schools in Cape Town sent parents a letter, which News24 has seen, which stated that a Grade 9 girl had tested positive for Covid-19.

“Her sibling and parents were also tested and all tested negative. The family is enforcing self-quarantine and has been since Thursday afternoon,” the letter says.

“In view of the rising numbers, President Cyril Ramaphosa has called for an urgent Cabinet meeting to be held on Sunday. This meeting will explore ways of intensifying the country’s response to this outbreak,” Mkhize said in a satement on Saturday.

On Friday, the department said the number of cases stood at 24.

Detailing the eight new cases, the NICD said:

In Gauteng, the new Covid-19 cases comprise of:
A 39-year-old woman who travelled to Switzerland and Austria.
A 50-year-old man who travelled to Austria,
A 21-year-old woman who travelled to Italy.
A 57-year-old man who travelled to Switzerland;
A 79-year-old from KwaZulu-Natal man reported having travelled to Greece and Italy.
A 52-year-old man travelled to Switzerland;

The two cases from the Western Cape comprise of:
A 46-year-old man who travelled to Italy.
A 50-year-old man who travelled to Switzerland and Austria.

“The eight patients have since been isolated and are receiving care,” said the NICD.

Seven new cases have now been confirmed in Gauteng:

A 76-year-old man who had travelled to the UK and the US;
A 72-year-old woman who had travelled to the UK and the US;
A 47-year-old man who had travelled to the UK and the US;
A 52-year-old man who had travelled to Germany;
A 38-year-old man who had travelled to the Netherlands and Germany;
A 62-year-old man who had travelled to the Netherlands;
A 19-year-old woman who had travelled to France and Italy.

There are six new cases in the Western Cape:

A 27-year-old man who had travelled to Brazil;
A 33-year-old woman who had travelled to France;
A 49-year-old man who had travelled to France and Italy;
A 14-year-old woman who had travelled to the US and Dubai;
A 73-year-old man who had travelled to the UK;
A 32-year-old man who had travelled to the UK.
One more case has been announced in KwaZulu-Natal.

A 47-year-old man who had travelled to Switzerland.

Mkhize says all patients had been informed and all information has been verified. Contact tracing is now underway.

Ex-generations star accuses advocate

A former Generations actress has opened a case of rape against a Joburg-based advocate – 13 years after the alleged incident.

The well-known actress, who cannot be named for legal reasons, opened the case at the Rosebank police station in Joburg on

November 20 last year.

In a police statement seen by Sunday World, the actress details how she became a victim of the legal eagle.

She said she had asked the advocate, who also cannot be named, to pick her up from the SABC studios in Auckland Park and drop her off at home on May 5 2006.

“On the way to home, she noticed that the advocate took the way to Rosebank,” reads the statement. She said they arrived in Forest Town suburb.the legendary thespian, who is in her late 40s, said the advocate got off and went into the house. He returned after a few minutes. He asked her to follow her back into the house because he wanted to show it to her.

“He started showing her the rooms until they end[ed] up in the bedroom. He started to touch her and she refused. He forced her and overpowered her. He undressed her pants and panty and penetrated her vagina through [sic] his penis,” reads the statement.

The award-winning actress said the advocate then took her home after raping her.

After opening the case last year, the police investigated and referred the case to the National Prosecution Authority’s (NPA) South Gauteng office for a decision on whether to prosecute.

NPA spokeswoman Phindi Mjonondwane confirmed that the case had been referred to the authority, but declined to elaborate.

“The NPA will consult with the complainant next week

Friday to discuss the matter before making a comment in the media,” she said.

Gauteng provincial police spokesman Mavela Masondo confirmed that the actress had opened a case against the advocate and they have refferred it to the NPA for a decision.

The actress, who also acted in the SABC 2 show Muvhango, ignored our phone calls and messages sent to her phone. Attempts to solicit comments from the advocate also drew a blank.
