The extradition case of the flamboyant Malawian prophet Shepard Bushiri could take a new twist amid reports that the Kenyan and Malawian doctors released sworn affidavits alleging that a decision allegedly made by Malawi’s Director of Public Prosecution, Dr Steve Kayuni reduced the child’s chances of survival from a hopefully 90% to just 5%.

The late Israella Bushiri (8), was refused medical evacuation at Kamuzu International Airport in the country’s capital Lilongwe in February, 2021. A private medical ambulance chartered by the family was turned away at the airport. Israella was only permitted to leave Malawi on the 25th of February after the family approached the courts. She died on the 29th of March, in Nairobi, Kenya.

During her funeral service, David Zgambo, Bushiri’s brother-in-law told mourners that Steve Kayuni was responsible for Israella’s death.

“Everything was cleared. The ambulance was ready. But we were told that the child could not travel to get treatment. I spoke to the director of immigration who told me that there was no reason for the child to be refused evacuation. We were then told that Steve Kayuni had ordered that the child be forced to stay.

“As a medical doctor I was afraid. We called him and he didn’t pick calls. We even sought his audience and were turned away at the gate. This as the child’s condition was deteriorating rapidly. It is my opinion, as a doctor and that of others, that the delay in getting her treated led to her death.”, he said.

Speaking at the same funeral, Shepherd Bushiri absolved the government of Malawi of any wrongdoing, but said a single person was behind the block that led to the child’s death.

“I can assure you. The government of Malawi was not involved (in the decision to block Israella’s travel). It was the actions of one single individual. I don’t know what me or my family or my daughter ever did to him and why he did this. But we accept the will of God.”, he said, without naming Kayuni directly.

But Israella’s doctors, who tended to her until she died have now released documents and a scathing affidavit that implies Kayuni’s decision to delay the child’s treatment led to her death.

“The child reacted well initially to treatment, but required ventilators, and advanced medical care which was not availed in Malawi. Her condition was life-threatening but she had at least 95% chances of recovering if she had received immediate care. The delay allowed the infection to progress unmitigated, damaging the lining of her lungs and causing mucus build-up.

“By the time she was eventually released, she only had 5% chances of survival. Had she been allowed to travel when the evacuation was first ordered, she would have survived”, reads part of the affidavit written by the doctors and submitted to Bushiri’s lawyers, and signed by Kenyan police.

In an interview after the Bushiris appeared before a Lilongwe Magistrate, Steve Kayuni pleaded no comment to questions surrounding Israella’s death.

“No comment. It was a court decision and court process which is still underway. No comment”, he said.

Kayuni also refused to confirm or deny the allegations by the Bushiri family that it was his decision to block the child’s travelling.

Kayuni is the lead prosecutor in the extradition case between the Bushiri’s and South Africa.

Sources within the family stated that the Bushiris intend to lay criminal charges of involuntary manslaughter (culpabale homicide) against “whoever made that decision to stop the medical evacuation”

Bushiri’s spokesperson, Ephraim Nyondo told Zim Morning Post that if any wrongdoing was proven, the family would seek justice.

“We are hurt by the passing of Israella. She was only 8 years old. It is heartbreaking to even hear of suggestions that her passing could have been avoided. If there was any wrongdoing by any persons, then we will obviously seek justice”.

Meanwhile, Bushiri’s extradition case was adjourned to June 04 after the courts.

During the court proceedings magistrate Patrick Chirwa said “The SADC Protocol says it must be ratified by member states in line with their individual constitutions.

“The constitution of Malawi states that any treaty in Malawi must be domesticated by an act of Parliament to become valid.

“It is not disputable that treaty has not been domesticated and ratified by an act of parliament in Malawi,” he said.

The SA Reserve Bank (SARB) has seized R225,680.92 from Mary Bushiri’s Nedbank account and R19.7m from the Gupta-owned Sahara Computers’ SA bank account.

On Wednesday the government gazette published a notice by Reserve Bank deputy governor Kuben Naidoo for the forfeiture of the money and any interest accrued from Sahara’s Nedbank account and its deposit into the National Revenue Fund.

The forfeiture was made according to the provisions of Exchange Control Regulation 22B, which is for the “forfeiture and disposal of money or goods attached or in respect of which orders have been issued or made”. The exchange control regulations fall under section 9 of the Currency and Exchanges Act.
SA banks unbanked the Gupta brothers Tony, Ajay and Atul in 2016 after allegations of corruption and state capture.

In 2019 the US Treasury department sanctioned Ajay Gupta, Atul Gupta, Rajesh Gupta, and Gupta associate Salim Essa who they called “members of a significant corruption network in SA that leveraged overpayments on government contracts, bribery, and other corrupt acts to fund political contributions and influence government actions”.

Last year the Sunday Times reported that Sahara reportedly owed creditors R467m.

Sahara Computers became one of SA’s largest information technology suppliers and reportedly had three cricket stadiums named after it, including Newlands cricket stadium which was previously Sahara Park and Kingsmead stadium in Durban.

Atul and Tony and their wives Arti and Chetali resigned as directors of the company in 2016. In late 2017 the Sahara Computers offices in Midrand were abandoned, according to a News24 report at the time.

The Guptas were not the only people in the sights of the SARB.

On Thursday last week Naidoo also signed a notice and order of forfeiture for R225,680.92 from Mary Bushiri’s Nedbank account.

Bushiri is a fugitive fighting extradition to South Africa along with her husband, controversial charismatic self-styled leader of Enlightened Christian Gathering church, Shepherd Bushiri.

The Bushiris fled to Malawi in November last year after they were granted R200,000 bail in the Pretoria magistrate’s court.

They were arrested in October last year on charges of money laundering, fraud and theft.

Should the extradition application be granted by the Lilongwe court, the Bushiris will be returned to SA to stand trial.

Pastor Shepherd Bushiri’s walls of Jericho are starting to tumble and staff at his hotel in Rustenburg have not been paid for three months, according to sources.

A source, who requested anonymity, said: “We are not surviving, some of the workers catch mopane worms to add to their food at night.”

Bushiri’s lawyer, Terrance Baloyi, did not respond to requests for comment on the allegations.

Bushiri, owner of the Sparkling Waters Hotel and Spa, and his wife Mary skipped the country this month after their release on bail. They and three others stand accused of theft, fraud, and money laundering involving over R100 million.

Five warrants of arrest have been issued for Bushiri.

The hotel employees, some of whom have been working there for 10 to 20 years, do not know when they will be paid again.

The source said two weeks ago they were called to a meeting with a shareholder who said he was taking over as Bushiri had not repaid a loan to him involving the hotel. But he would not pay the salaries due to staff.

Another source said 53 employees had approached the Commission for Conciliation, Mediation, and Arbitration in Rustenburg.

None of the hotels’ phone numbers were answered yesterday.

The Pretoria Magistrate’s Court ordered that the property should be forfeited as a result of the couple violating their bail conditions. The NPA has confirmed that the home would be sold on auction after the pair fled the country.

‘Prophet’ Shepherd Bushiri’s multimillion-rand house in Centurion will be auctioned off to the highest bidder after being forfeited to the state. National Prosecuting Authority spokesperson Sipho Ngwema explained that the luxurious home would be placed on auction, commenting further that:

“The state will have to auction it so that it realises its value and the money will be given to the fiscus.”

Ngwema revealed that it is unlikely that Bushiri would appeal the order unless he submits a credible reason as to why he contravened his bail conditions. Bushiri took to Facebook recently to make it clear that he was well aware of the fact that his assets in SA have been seized.

“I am also informed that some of my assets in SA have been confiscated by authorities, to which I say: ‘My right to life is more important than any asset in this world.”

Bushiri was celebrating his release from prison after Malawian authorities had taken them into custody:

“Whatever has happened today, I don’t see it as our victory, neither our lawyers. God has won. Tomorrow is better than today!”
A local court had seen its magistrate releasing the duo ‘unconditionally’ despite warrants for their arrest being issued in South Africa.

Few days before his arrest for money laundering and fraud amounting to over R100m, fugitive and self-proclaimed prophet Shepherd Bushiri whiled away time in the company of two of his close associates at one of his prized possessions, Sparkling Water Hotel and Spa.

The property, nestled on the foot of the Magaliesberg mountains in North West, is one of many commercial entities owned by Bushiri, which he left behind when he and his wife Mary skipped the country for Malawi last week.

The hotel is also where the leader of the Enlightened Christian Gathering Church regularly retreated to after leading sermons, according to neighbours and workers who spoke on condition of anonymity.

According to employees, the man called Major 1 by his flock, spent time in a private executive suite which could only be accessed through facial recognition technology.

Employees said there were times when Bushiri would bring a group of friends and take them to a private secluded cottage, which he calls Peace Mountain, which has the view of the mountains. There is also also a stable with eight horses.

There are days in which he’d bring a group of friends and accommodate them at the Peace Mountain. When there he would be riding his horses. Bushiri loves horses,” said the worker.

He usually came to the hotel in the early hours of the morning, accompanied by a large convoy of cars and spent up to three days here,” said another employee.

During his bail application in the Pretoria magistrate’s court, Bushiri requested to be allowed to travel to North West to be at the hotel, a request that was granted by magistrate Thandi Theledi.

According to the company website, Bushiri acquired the property with 53 rooms for $150m in 2016. Bushiri wrote on the website that his ultimate goal would be for the hotel to employ up to 5,000 people and have 2,000 rooms, which would accommodate up to 3,000 guests.

When journalists visited the hotel yesterday, security guards denied them access to the property, saying it was fully booked this week.”

Guests can pay from R1,050 for a standard room a night to up to R5,000 for some exclusive suites. Massage prices range between R250 and R540. A facial costs R780. A half-day deluxe spa package will set you back R2,550.

The workers also said though the hotel had three dining areas, guests were only allowed to access two of them.

There is a dining hall called Major 1. If a guest wants to eat there, the hotel staff will call Bushiri directly and if he is satisfied with the amount a guest is willing to pay for sitting at Major 1, he gives them permission, said another worker.

Self-proclaimed prophet and leader of the Enlightened Christian Gathering (ECG) church Shepherd Bushiri says there is nothing sinister about him and his wife Mary having 10 passports.

Bushiri took to Facebook on Wednesday morning to respond to remarks made by home affairs minister Aaron Motsoaledi before parliament on Tuesday explaining the couple’s escape to Malawi last week.

Motsoaledi told MPs the fugitives have five passports each, none of which are South African. He said the department has all their passport numbers and had established that none of them were used to skip SA.

“I must emphasise that Mr Bushiri has five passports. None of them are South African. They were all issued in Malawi. We’ve got their passport numbers. Mrs Bushiri also has five passports,” he said.

Bushiri said the minister’s comments created the wrong impression, and “strengthened my fear that I will not get a fair trial in SA”.

“The impression is that these are passports with different names and details. Once again, this issue is before the high court in SA. For the record, my wife and I have passports, each one of which is a diplomatic passport and one is a normal passport. We submitted all these passports to the investigating officer in SA.

“Because we are frequent travellers due to the work of our ministry, the other passports are full. However, they have international visas so we kept them. There is nothing sinister about that,” said Bushiri.

He denied that he had fled to Malawi to seek “political intervention”, but “justice before the Constitution of the Republic of Malawi”.

Bushiri also said he would hand himself over to the authorities to “legally” defend his decision to skip SA for his home country.

About two hours after Bushiri released the statement, reports emerged that he and his wife had been arrested at their home in Lilongwe after a raid by Malawian authorities.

Sunday Times Daily quoted an unconfirmed report from a local publication, which stated 15 police officers were involved in their arrest.

Hawks spokesperson Katlego Mogale confirmed on Wednesday that a second warrant of arrest had been issued for the couple after they failed to appear before the Pretoria high court. The warrant was issued on Tuesday.

The Bushiris were granted bail of R200,000 each by the Pretoria magistrate’s court two weeks ago. They were arrested in October and face charges of fraud, money laundering and theft relating to an “investment scheme” amounting to R102m.

Their bail conditions included that the couple may only travel between Gauteng and the North West. They were also required to report to their nearest police station every Monday and Friday.

Mboro has spoken out about allegedly receiving death threats from the ECG leader’s followers.

The beef between Pastor Mapaseka ‘Mboro’ Motsoeneng and self-proclaimed prophet Shepherd Bushiri is far from over, with Motsoeneng – the Incredible Happenings church leader – now alleging that he was denied service at a Nando’s because of Bushiri supporters.

Motsoeneng says this happened after he attended Bushiri’s court appearance on Monday.

“We are not getting our orders, even when we got in here, this Bushiri ‘boy’ did not want to help us. Nando’s is not owned by Bushiri. We are not going to suffer by ‘Papa’. I have been sitting here waiting for my order because of ‘Papa’. Bushiri must go home,” Motsoeneng says in the video.

After Bushiri, his wife Mary and three others were taken into police custody in October, Mboro took credit for the arrest, saying he had created an atmosphere that made it possible for the Enlightened Christian Gathering (ECG) church leader and his wife to get arrested.
Further criticising Bushiri, Motsoeneng said “false” prophets were on the rise and that “many pastors, fraternities and movements are afraid of Bushiri”.

During Bushiri’s court appearances, Motsoeneng has spoken out about allegedly receiving death threats from the ECG leader’s followers.
