House music sensation Lady Zamar has opened a case of rape against her ex-boyfriend and fellow musician Sjava.

The revered songbird, real name Yamikani Janet Banda, opened the case at Lyttleton police station in Pretoria in November after taking to social media platforms and claiming that Sjava had s.e.xually violated her.

The case was later transferred to Thohoyandou police station for investigation. According to the police statement, seen by Sunday World, Lady Zamar alleged that Sjava raped her at the Porche Villa Hotel in Thohoyandou after their performance at the Royal Heritage festival in Venda, Limpopo, on September 9 2017. Detailing the incident, the Collide hitmaker alleged Sjava had invited her to his hotel room after their performance at the show.

They had travelled to the hotel in separate vehicles. She alleged that when they arrived in the hotel room, Sjava slept but she didn’t. Sjava woke up in the morning and started kissing her and she kissed him back.

Sjava then performed oral s.e.x on her and when she tried to stop him, he put on a condom and penetrated her, she said.

The police statement captures the incident thus: “He woke up and started kissing her and she kissed him back. And he started taking her clothing of (sic) and she kept quite (sic) and did oral s.e.x. He took the c0nd0m and put it on his pen!s and penetrated her. She tried to stop him during the oral s.e.x but he did not stop. She just let it happen as he was stronger than her. She was crying as it was painful. When he finished he got off and held her and told her to sleep on the same day at 12:00.”

Lady Zamar said after the rape incident, she and Sjava had travelled back to Joburg together in the same vehicle. She said she has never been herself since the alleged incident. Limpopo police spokesman Motlafela Mojapelo confirmed Lady Zamar had opened a case of rape against Sjava. He said the police have completed their investigations and referred it to the National Prosecution Authority for a decision on whether to prosecute.

“We confirm that a case of rape was opened on 2019-11-14 at Lyttleton SAPS in Gauteng province. It was then transferred to Thohoyandou SAPS in Limpopo on 2019-11-22 for further handling as the alleged incident was reportedly committed in Thohoyandou policing precinct,” he said.

Mojapelo said although Sjava was questioned by the police, he was not arrested due to the complexity of the case.“the alleged incident reportedly happened on 2017-0909 and the case was only opened after two years and this requires meticulous investigations, as in other cases, to ensure that every piece of information is properly followed up,” he said.

Despite promises to provide comment, Sjava had not done so at the time of going to press. When Lady Zamar publicly accused Sjava of abuse on Twitter last year, he responded: “I am aware of the false allegations relating to abuse and assault contained in tweets by Yamikani Banda [Lady Zamar] on 29 October 2019 and the media articles based on those allegations. On the advice of my legal advisers, I am pursuing the matter through formal legal channels.”

Lady Zamar, speaking through her PR firm, confirmed she had opened a case against Sjava and said the matter was sub-judice.

Twitter was abuzz on Sunday morning, after Sunday World revealed that musician Lady Zamar has opened a case of rape against an ex-lover, Sjava.

According to reports, Lady Zamar opened the case in November last year at the Lyttleton police station in Pretoria. It has since been transferred to Thohoyandou police station for further investigations.

The case details how Lady Zamar was allegedly raped by Sjava after the two musicians performed at the Royal Heritage Festival in Limpopo in 2017.

Since the announcement, Twitter users have been accusing women of not believing that Lady Zamar was raped by Sjava, with some questioning why a case was only being opened almost three years later, and others saying Lady Zamar was only opening the case because Sjava brought his wife to a concert she was performing at.

However, the news did not come as too much of a shock to fans of Lady Zamar, who were aware that she opened up about alleged verbal and s.e.xual abuse suffered at the hands of her ex-lover in October last year.

“You guys are exhausting man. I’ve been saying… Your precious Zulu man is a liar and a cheater. Cheers to every person that didn’t believe me when I told them that that nigga’s married.. coz in your face.. mxm y’all are exhausting.. now y’all wanna drag me coz I didn’t know?,” she said last year, while also addressing rumours of her past relationship with a married man.

She said: “I was abused (verbally and once s.e.xually) and used… I was lied to and cheated on. Did I know? No. Did people tell me who knew? Yes, some… got inboxes and calls .. Did I ask? Yes. Did people I knew know what kind of man he is? Yes. Did they protect him? His friends? Yes.”

Other Twitter users have shown solidarity and support for Lady Zamar, and all women who have been victims of s.e.xual abuse and assault.

You did the right thing for you and your daughter at the time and you should be proud of yourself. Your baby daddy was very selfish – even if he wasn’t ready to be a father, he had no right to tell you to terminate the pregnancy. The bond you have with him because he’s the father of your child will always be there but make sure it doesn’t confuse you and make you believe you still love him. If he says he wants to do right by his child, then let him. What you need to do is agree on the terms of his involvement with the child.

He should not come with unreasonable demands, or the expectation that being part of the child’s life automatically means being part of your life too. I think visiting your nearest family advocate office to draw up a parenting plan will benefit you. This will ensure that whatever is agreed on regarding the child’s care and contact is in black and white and can be made into a court order if necessary.

A full-scale military rescue mission is under way to evacuate more than 130 South Africans trapped in China’s Wuhan city, as the epidemic tightens its grip on a nervous world uncertain what to expect next.

Once they are safely back in the country, the South African evacuees will be quarantined at a secret resort in the Free State where they — along with the flight crew and resort staff — will be kept under heavy guard for 21 days.

The elaborate, high-level evacuation will involve specialised bio-hazard military health and air force personnel.

A chartered plane — “preferably from SAA” — is due to leave tomorrow or on Tuesday and return later in the week.

None of those involved have shown any sign of having contracted the virus, which by late yesterday had spread to 57 countries, claiming the lives of 2,933 people, with 85,700 having been infected and under treatment.

SA has yet to have a confirmed case of the new coronavirus.

The decision to offer voluntary evacuation to South Africans is an abrupt reversal of an earlier decision to keep them there, even though other countries have been pulling out their nationals from China.

This week, facing protests from families of loved ones trapped in China, the epicentre of the virus, the government changed tack and decided those who had not tested positive would be brought home.

The virus has sent global markets into free fall, hitting their worst lows since the financial crash of 2008 and triggering fears of a global economic recession as more countries are affected.

The Sunday Times has been given rare access to information on the evacuation, which will include government health officials, among them communicable disease experts, working to bring back at least 134 citizens.

Alongside pressure from families to bring home their loved ones, a well-placed source with knowledge of the evacuation plan said the decision was based on growing safety concerns for those in the lockdown zone.

“Information gathered on the spread of the disease, the true extent of those infected and their treatment, is alarming. The information warranted an urgent evacuation,” the source said.

Roughly 200 South Africans live, work and study in Wuhan. The majority of those returning are students.

The 10 South Africans trapped in Japan on board the Diamond Princess cruise ship will not yet be evacuated. An additional two South Africans on board have tested positive for the virus and have been quarantined.

The Sunday Times has been told the evacuation team consists of communicable disease experts and government and military health services officers, including specialised staff from 7 Medical Battalion. The battalion’s members are trained in biochemical warfare.

Defence ministry spokesperson Siphiwe Dlamini said the flight would be chartered, “preferably from SAA”. He said China had given the plane only eight hours on the ground.

“Those returning will be collected from a special holding facility at the airport and flown back to SA.

“Once they have landed they will be transported by bus to a resort in the Free State identified as the quarantine facility.”

The source said the aircraft would land at Bloemspruit air force base in Bloemfontein.

Dlamini said World Health Organisation (WHO) protocols dictated a quarantine period of 14 days, “but because this is a military option we are quarantining people for 21 days”.

“The quarantine is necessary to ensure, that in the unlikelihood of anyone showing signs of infection, they can be expeditiously treated at specifically identified hospitals. Everyone in contact with those coming home will be quarantined, including aircrew, military personnel and the bus drivers.”

He said the resort and its surrounding areas are a designated military zone and will be in total lockdown.

“The facility will be under heavy guard from both the military and the police.”

Health ministry spokesperson Lwazi Manzi said: “The quarantine area is a national key point. We appeal to people to not try to sneak into the facility to be with their families. Anyone who does will be detained and quarantined.”

Meanwhile, the steep drop in world

markets has led to the combined fortunes of the world’s 500 richest people falling by $444bn (R6.9-trillion), according to the Bloomberg billionaires index. The world’s three richest people — Amazon.com’s Jeff Bezos, Microsoft co-founder Bill Gates and LVMH chair Bernard Arnault — incurred the biggest losses, with their combined wealth dropping about $30bn.

Stock markets are expected to fall further tomorrow after a record contraction in China’s manufacturing and service sectors.

Gates on Friday urged wealthy nations to help low- and middle-income countries strengthen their health systems in hopes of slowing the spread of the coronavirus, which he said had started to behave like a “once-ina-century” pathogen.

“By helping countries in Africa and South Asia get ready now, we can save lives and also slow the global circulation of this virus,” Gates wrote in an editorial in the New England Journal of Medicine.

The virus is much harder to stop than similar viruses that caused Middle East respiratory syndrome or severe acute respiratory syndrome, Gates wrote. The Bill and Melinda Gates Foundation has pledged $100m to fight the outbreak.

Gates’s plea was echoed by the WHO, which said the risk is very high that the virus will have a global impact.

The WHO implored governments to swing into action to contain the virus before it becomes widespread.

In the US, public health officials said they have identified four “presumptive” coronavirus cases — two in California, one in Oregon and another in Washington state — believed to have emerged from community transmission of the infection. All four people diagnosed had no history of travel to a country where the virus is circulating and no close contact with an infected person.

The numbers of deaths and new infections appear to be dropping in China, but they are picking up in other countries.

Iran, which has the highest death toll outside China, has had 34 fatalities and 388 infections. South Korea yesterday urged citizens to stay indoors as it warned of a “critical moment” in its battle against the coronavirus after recording the biggest daily jump in infections, as 813 new cases took the tally to 3,150, with 17 dead.

Nigeria, Mexico and New Zealand were among countries reporting their first infections. There were more cases in Australia and Thailand, and in France confirmed cases jumped by 19 to 57.

Professional sport has taken a hit. In Italy, where 21 people have died and 889 been diagnosed, soccer clubs Juventus and Inter Milan will play behind closed doors today.

There have been doubts about the Olympics in Japan this year, though the International Olympic Committee said it “is fully committed to a successful Olympic Games in Tokyo starting on July 24”.

Japanese Prime Minister Shinzo Abe requested the nearly month-long closure of schools to curb the spread of the virus.

Amazon has reportedly removed more than 1-million products from its digital store that are fraudulently branded as coronavirus cures or safeguards.

Two former intelligence ministers have been denied security clearance and cannot be posted as ambassadors after months of training for the job.

The Sunday Times has reliably learnt that Siyabonga Cwele and Dipuo LetsatsiDuba failed vetting and cannot get security clearance, which is a prerequisite for them to be sent abroad as ambassadors.

The State Security Agency (SSA) flagged what it says was Letsatsi-Duba’s improper relationship with former president Jacob Zuma as one the main reasons she was denied the top-secret clearance.

Cwele was nominated by President Cyril Ramaphosa to be SA’s top diplomat in Beijing — a strategic mission to SA’s biggest trading partner, China — replacing ambassador Dolana Msimang.

Letsatsi-Duba was due to be SA’s ambassador in Ankara, Turkey — an important post for SA’s interests in the Middle East.

Ramaphosa nominated the pair last year after they failed to make it back to the cabinet.

Insiders with knowledge of the matter said the head of the SSA domestic branch, Mahlodi Muofhe, wrote to the director-general of international relations, Kgabo Mahoai, informing him of his decision not to grant Cwele and Letsatsi-Duba clearance.

Insiders said that Muofhe claimed that Letsatsi-Duba lied about a “business relationship” with Zuma dating back to 2005 when she was an MEC in Limpopo and Zuma was deputy president of the ANC.

Letsatsi-Duba has claimed that she bought a number of cars through her family business for ANC activities at Zuma’s request. But Muofhe is said to have poked holes in that story.

The former minister was also accused by the SSA of under-declaring her financial position.

“Muofhe said she lacks integrity and honesty and cannot be trusted,” said a source.

Letsatsi-Duba was appointed intelligence minister in 2018 but axed from the job just a year later.

For more than a decade, Cwele held cabinet posts in various portfolios under presidents Kgalema Motlanthe, Jacob Zuma and Ramaphosa. During his term as intelligence minister under Zuma, Cwele was the subject of controversy when his former wife was jailed for sending a drug mule to Brazil.

The two former ministers are both members of the ANC’s national executive committee and Letsatsi-Duba was instrumental in helping to get Ramaphosa elected ANC president in 2017.

Letsatsi-Duba and Cwele have appealed against the vetting decision to intelligence minister Ayanda Dlodlo.

Letsatsi-Duba also denied the claim that she under-declared her financial position and lied about having R16m in a trust account. She is said to have stated that she only had R200,000 in that account.

She is said to have denied ever having a business relationship with Zuma.

Government insiders said this scandal would leave Ramaphosa red-faced in diplomatic circles and pose trouble for him in the ANC.

Those sympathetic to Letsatsi-Duba said Muofhe was “playing politics” with the SSA and its vetting process.

The former ministers attended four months of diplomatic training at the department of international relations & co-operation (Dirco) last year and completed their courses in December.

Their credentials had already been sent to the two countries ahead of their arrival. Diplomats are not received by a host country if there are questions about their credentials.

State security spokesperson Mava Scott would not answer questions sent to him.

“Vetting is a confidential exercise, which we execute under extreme conditions of confidentiality,” he said.

A senior government official with direct knowledge of the process said it was extraordinary that two former ministers of intelligence didn’t make the cut.

“SSA never discloses the reasons but they always have valid reasons — especially if you consider how senior these people are,” he said. The process was not political and was done by “professionals at SSA who check finances, contacts, activities, liaison, property etcetera. The criteria are applied with no bias.”

Dirco spokesperson Lunga Ngqengelele failed to respond to questions sent to him. Presidency spokesperson Khusela Diko said the presidency does not comment on vetting issues.

It has previously been reported that Letsatsi-Duba was a paid SSA operative while she was an MEC in Limpopo. The source said this “definitely was part of the reasons why her clearance was rejected”.

Letsatsi-Duba has vehemently denied that she was an agent while an MEC.

She could not be reached for more recent comment. However, sources close to her said she believed intelligence officials are seeking revenge for the changes and decisions she made during her tenure as minister.

“She is going to fight this and appeal it because she believes that there was a conflict of interest. The SSA was not supposed to vet her because of the conflict,” one source said.

The person said she believed the process was politicised.

Cwele was also unavailable for comment. Lobby groups and opposition parties had previously accused Cwele of treason after he was implicated in a report on the collapse of the intelligence agency.

Ambassadors are appointed through a recommendation from the ANC’s deployment committee or the minister of international relations. Once the president agrees, he sends a letter of nomination to the individual. If they accept, they are called to attend a training course of between three and four months’ duration. Government insiders said nominees ought to be vetted before they begin training.
